Justice Babatunde Quadri of a Federal High Court, Jos, Plateau State has
\nruled that a former governor of Gombe State, Senator Danjuma Goje, has a
\ncase to answer on counts eight and nine of the 21-count charge preferred
\nagainst him by the Economic and Financial Crimes Commission, EFCC.Goje, a serving Senator, is standing trial along with a former Executive
\nChairman of the state\u2019s Universal Basic Education Board, Aliyu El-Nafaty;
\nand S.M. Dokoro for an alleged N5 billion fraud. A fourth defendant, the
\nex-governor\u2019s cousin, Sabo Tumu, who is now late was removed from the
\ncharge sheet.They are alleged to have been involved in alleged financial impropriety,
\nincluding the award of contracts for food supply to the state\u2019s Government
\nHouse, during his tenure.<\/p>\n

The EFCC had through its counsel, Wahab Shittu, closed its case against
\nthem, on May 31, 2018 after calling 25 witnesses and tendering several
\ndocuments to prove its case.<\/p>\n

However, rather than open its defence, Goje through his lawyers, filed a
\n\u201cno-case\u201d submission on September 14, 2018.<\/p>\n

Counsel for the EFCC, Wahab Shittu, had objected to the application, which
\nwas made by Paul Erokoro, SAN.<\/p>\n

\u201cWe are making a no-case submission because all the charges against us
\nhave not been proved by the prosecution,\u201d Erokoro had said.<\/p>\n

Shittu, however, countered his argument and urged the court to ask them to
\nopen their defence, stressing that, \u201cin view of documents and evidences
\nbefore the court, the defendants have cases to answer.\u201d<\/p>\n

At the last sitting on January 25, 2019 the trial judge had adjourned to
\ntoday, March 22, 2019 to rule on the \u201cno-case\u201d submission.<\/p>\n

Ruling on the said application, Justice Quadri while discharging the
\ndefendants on 19 of the 21 counts, held that the defendants had a case to
\nanswer on counts eight and nine, and ruled that they should open their
\ndefence on May 8, 2019. \u201cThe 1st and 3rd defendant who the prosecution has
\nmade a prima facie case with respect to count 8 and 9 are called upon to
\nenter their defence\u201d, the judge ruled.<\/p>\n<\/div>\n<\/div>\n
