The trial of Erastus Akingbola, a former Managing Director of the defunct
\nIntercontinental Bank Plc, continued on April 5, 2019 with the Economic
\nand Financial Crimes Commission, EFCC, presenting fresh evidence against
\nhim.<\/p>\n

Akingbola is standing trial on an amended 22-count charge bordering on
\nabuse of office, conversion of funds belonging to Intercontinental Bank
\nPlc, and stealing.<\/p>\n

The fresh evidence, which included the statements of accounts and accounts
\nparticulars of Tropics Securities Limited, Tropics Properties Limited and
\nTropics Finance with Access Bank, were tendered in evidence through the
\nthird prosecution witness, Iyoyo Eweh.<\/p>\n

Prosecuting counsel, Rotimi Jacobs, SAN, informed the court that Eweh, a
\nstaff of Access Bank Plc was a substitute for the next witness to be
\ncalled on the witness list.<\/p>\n

\u201cThe reason Iyoyo Eweh is a substitute is because the third witness to be
\ncalled has left the bank and has absconded from the country, and the
\nprosecution had to bring Iyoyo as a substitute witness majorly to tender
\nthe documents through him,\u201d Jacobs said.<\/p>\n

Defence counsel, Wole Olanipekun, SAN, however, raised objections, arguing
\nthat a witness cannot be substituted in a criminal trial. But Jacobs
\napologised to the court and to the defence for the new development.
\nConsequently, Eweh was allowed by the court to testify.<\/p>\n

Under examination, he told the court that he was recently contacted by the
\nEFCC to provide the statements of accounts and accounts particulars of
\nTropics Securities Limited, Tropics Properties Limited and Tropics Finance
\nwith Access Bank.<\/p>\n

\u201cThe documents were provided, and I was asked to come and tender them in
\ncourt,\u201d he added.<\/p>\n

Jacobs, thereafter, urged the court to accept the documents in evidence
\nagainst Akingbola.<\/p>\n

Olanipekun, however, opposed the admissibility of the documents, arguing
\nthat, “these documents sought to be tendered by the prosecution are
\ndocuments dated April 3, 2019, 48 hours ago, which seem to be illegal and
\nit is against public policy\u201d.<\/p>\n

He added that: \u201cOnce a case is brought before the court, it is presumed
\nthat all investigations have been concluded and no further investigation
\ncan be done or tendered through document in court.<\/p>\n

\u201cThis case has been pending for 10 years, and now, the prosecution came
\nwith evidence been sourced 48 hours ago.<\/p>\n

\u201cMore so, the documents are Access Bank Plc documents, which are processes
\nor made as a result of evidences already given in order to frustrate the
\ninterest of justice.<\/p>\n

\u201cI urge your Lordship to reject this sourced and self-serving documents,
\nwhich has also made a substitution in the original evidence after
\nproceedings commenced.<\/p>\n

\u201cAccess Bank Plc is a beneficiary of the prosecution of the defendant and
\nall the documents are signed by Access Bank as an interested party in this
\ncase,\u201d Olanipekun said.<\/p>\n

Responding, Jacobs argued that, the prosecution was not bound to limit
\nitself with provision of witness and documented facts in a criminal
\nmatter.<\/p>\n

\u201cProsecution may at any time before the judgement of the court on a case,
\nfile and serve notice of additional proof of evidence which may include
\nadditional evidence,\u201d Jacobs said.<\/p>\n

He added further that, \u201cthe documents sought to be tendered are old
\ndocuments of Intercontinental Bank Plc but sought to be tendered by a mere
\nstaff of the bank who has no interest in the case.\u201d<\/p>\n

He further argued that Access Bank Plc was not a party, or an interested
\nparty in the matter.<\/p>\n

“The only interested party in this case is the Federal Government of
\nNigeria and Dr. Erastus Akingbola,” Jacobs added.<\/p>\n

Justice Olatoregun, thereafter, adjourned to April 18, 2019 for ruling on
\nthe admissibility of documents.<\/p>\n<\/div>\n<\/div>\n
