{"id":66058,"date":"2019-04-08T04:53:58","date_gmt":"2019-04-08T03:53:58","guid":{"rendered":"http:\/\/pointblanknews.com\/pbn\/?p=66058"},"modified":"2019-04-08T04:53:58","modified_gmt":"2019-04-08T03:53:58","slug":"imo-west-senatorial-election-tussle-onyeriri-seeks-transfer-of-suit-against-okorocha","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/news\/imo-west-senatorial-election-tussle-onyeriri-seeks-transfer-of-suit-against-okorocha\/","title":{"rendered":"IMO WEST SENATORIAL ELECTION TUSSLE: ONYERIRI SEEKS TRANSFER OF SUIT AGAINST OKOROCHA"},"content":{"rendered":"<div id=\"m-4864286168020272027\" class=\"mail-message expanded\">\n<div class=\"mail-message-header spacer\"><\/div>\n<div class=\"mail-message-content collapsible zoom-normal mail-show-images \">\n<div class=\"clear\">The candidate of the People\u2019s Democratic Party, PDP, in the Imo West<br \/>\nSenatorial election, Hon Jones Onyeriri is seeking the discontinuation of<br \/>\nthe trial of the suit involving him, the All Progressives Congress<br \/>\ncandidate, Chief Rochas Okorocha and six others by Honourable Justice<br \/>\nTaiwo Taiwo.<\/p>\n<p>Onyeriri accused the Honorable Justice Taiwo Taiwo of the Federal High<br \/>\nCourt Abuja, of bias, fearing justice won&#8217;t be served.<\/p>\n<p>The PDP candidate had in a motion sworn to by his counsel, Chijoke Nzekwe<br \/>\nrequested the Chief Judge of the Federal High Court to transfer the suit<br \/>\nto another Judge noting that his client has\u00a0 lost confidence in the<br \/>\nability of the Honourable Justice Taiwo Taiwo to hold the scale of justice<br \/>\nin the matter<\/p>\n<p>Following the refusal of the Independent National Electoral Commission to<br \/>\ngrant him Certificate of Return, the APC candidate in the just concluded<br \/>\nNational Assembly election, Rochas Okorocha approached the Federal High<br \/>\nCourt for redress<\/p>\n<p>Apart from the PDP candidate, others who were joined in the suit included:<br \/>\nINEC, Senator Osita Izunaso, the APGA candidate, Nwachukwu\u00a0 Clement<br \/>\nIbeh Onyeoma and\u00a0 Precious Nwadike<\/p>\n<p>Although the\u00a0 Returning Officer of the Imo West Senatorial election,<br \/>\nProfessor Innocent Ibeawuchi\u00a0 declared Okorocha winner of the election he<br \/>\nrenounced the announcement stating that he did it under duress\u00a0 alleging<br \/>\nOkorocha\u2019s threats and intimidation<\/p>\n<p>\u201cI declared this thing before under duress; I\u2019m still under duress<br \/>\ndeclaring this one,\u201d Professor Innocent said.<\/p>\n<p>The suit came up for hearing\u00a0 on Friday 5th of April 2019 before<br \/>\nHonourable Justice Taiwo Taiwo of the Abuja Judicial Division of the<br \/>\nFederal High Court of Nigeria<\/p>\n<p>In his application seeking the transfer of the suit the PDP candidate<br \/>\nalleged that in the course of the said proceedings, the\u00a0 Judge made<br \/>\nutterances which clearly showed that he had taken sides in this matter.<\/p>\n<p>According to him, in spite of the\u00a0 \u00a0Notices of Preliminary Objection<br \/>\nraised by the him and the 3rd defendant challenging the jurisdiction of<br \/>\nthe Honourable Court to hear this matter the applications are yet to be<br \/>\ntaken by the Court.<\/p>\n<p>\u201cIt was evidently clear to all and sundry that His Lordship had made up<br \/>\nhis mind on what to do about this matter and taken a position on the<br \/>\napplications challenging his jurisdiction to hear the case before<br \/>\ncommencing hearing of the said applications\u201d, the motion stated<\/p>\n<\/div>\n<\/div>\n<div class=\"mail-message-footer spacer collapsible\"><\/div>\n<\/div>\n<div id=\"conversation-footer\" class=\"spacer\"><\/div>\n<!-- AddThis Advanced Settings generic via filter on the_content --><!-- AddThis Share Buttons generic via filter on the_content --><!-- AddThis Related Posts generic via filter on the_content -->","protected":false},"excerpt":{"rendered":"<p>The candidate of the People\u2019s Democratic Party, PDP, in the Imo West Senatorial election, Hon Jones Onyeriri is seeking the discontinuation of the trial of the suit involving him, the&hellip;<!-- AddThis Advanced Settings generic via filter on wp_trim_excerpt --><!-- AddThis Share Buttons generic via filter on wp_trim_excerpt --><!-- AddThis Related Posts generic via filter on wp_trim_excerpt --><\/p>\n","protected":false},"author":1,"featured_media":58944,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_lmt_disableupdate":"","_lmt_disable":"","footnotes":""},"categories":[5],"tags":[],"class_list":["post-66058","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-news"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v26.8 -
