{"id":66645,"date":"2019-05-14T20:35:10","date_gmt":"2019-05-14T19:35:10","guid":{"rendered":"http:\/\/pointblanknews.com\/pbn\/?p=66645"},"modified":"2019-05-14T20:35:10","modified_gmt":"2019-05-14T19:35:10","slug":"much-ado-about-nass-leadership-election","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/articles-opinions\/much-ado-about-nass-leadership-election\/","title":{"rendered":"MUCH ADO ABOUT NASS LEADERSHIP ELECTION"},"content":{"rendered":"<div id=\"m5115728915362365016\" class=\"mail-message expanded\">\n<div class=\"mail-message-header spacer\">By Sufuyan Ojeifo<\/div>\n<div class=\"mail-message-content collapsible zoom-normal mail-show-images \">\n<div class=\"clear\">\nAhead of its June 11 inauguration, there has been so much noise about<br \/>\nthe mode of electing presiding officers of the 9th National Assembly.<br \/>\nSome stakeholders canvass adoption of the secret ballot system while<br \/>\nsome others favour open ballot. Both have given reasons for their<br \/>\nrespective stance.<\/p>\n<p>Secret ballot advocates want confidentiality so that members can freely<br \/>\ncast their votes without fear of victimization by the superintending<br \/>\nmachinery of the governing All Progressives Congress (APC). Those<br \/>\npushing for open ballot want a restraining process that could be used to<br \/>\nrein in members of the governing party to vote for its endorsed<br \/>\ncandidates.<\/p>\n<p>Open ballot puts members-elect under intense pressure. It can influence<br \/>\nthe election in favour of the governing party\u2019s preferred choices,<br \/>\nexcepting where members or some members decide to dare the party and<br \/>\ndamn the consequences. Conversely, secret ballot gives members the<br \/>\nleeway to engage in real \u2018monkey business\u2019.<\/p>\n<p>For the APC, the fear of \u2018monkey business,\u2019 now, is the beginning of<br \/>\nwisdom. Having been once beaten in the 2015 National Assembly leadership<br \/>\nelection when Bukola Saraki and Yakubu Dogara upstaged its anointed<br \/>\ncandidates &#8211; Ahmad Lawan and Femi Gbajabiamila &#8211; for the positions of<br \/>\nSenate President and Speaker of the House of Representatives<br \/>\nrespectively, circumspection becomes imperative.<\/p>\n<p>Interestingly, the APC\u2019s anointed candidates that were defeated in<br \/>\n2015 are the same candidates being promoted by the party to lead the<br \/>\nNational Assembly in 2019. The question is: what has changed between<br \/>\nthen and now to avert a repeat of the 2015 debacle?\u00a0 It is possible that<br \/>\na whole lot has changed. But the attitude of the party leadership<br \/>\nsuggests otherwise. The party leadership and the anointed candidates do<br \/>\nnot appear surefooted; otherwise, the mode of election should not have<br \/>\nmattered, especially where the standing orders of the Federal<br \/>\nLegislature are unambiguous on the voting mode.<\/p>\n<p>The method of clothing leaderships at all levels of government with<br \/>\nauthority or legitimacy should not have been problematic had the quest<br \/>\nfor power been motivated by altruism. Selflessness is not an exemplar in<br \/>\nthe government and governance architecture of our nation. Institutions<br \/>\nand processes are always circumvented to satisfy predetermined narrow<br \/>\nends.<\/p>\n<p>The agitation for the circumvention of the extant standing orders of the<br \/>\nNational Assembly, which provides secret ballot as the mode of electing<br \/>\npresiding officers, speaks to the much fundamental malaise afflicting<br \/>\nour body-politic: the proclivity to violating rules and regulations and<br \/>\nthe impunity of scoffing the ramifications of the breach.<\/p>\n<p>The system is sadly subordinated to individuals\u2019 whims or caprices.<br \/>\nPretenders to leadership positions egregiously operate the system in<br \/>\nservice of their selfish agenda. Otherwise, I ask once more: why,<br \/>\nindeed, would some individuals advocate the adoption of open ballot when<br \/>\nthe standing orders of both the Senate and the House of Representatives<br \/>\nclearly provide for secret ballot?<\/p>\n<p>The fault is in political elite\u2019s mind-set of deliberately placing<br \/>\npersonal interest over collective, national interest. Political<br \/>\nleadership and power elite have always manipulated the system in<br \/>\ndesperate and selfish bids to appropriate authority and commonwealth in<br \/>\nfurtherance of personal gains. This is not solely APC\u2019s problem.<br \/>\nRegardless, it is buckling under the weighty pressure of its avowed<br \/>\ndetermination to deliver the individuals to whom it had micro-zoned the<br \/>\nleadership of the 9th National Assembly, perhaps preparatory to 2023<br \/>\npresidential politics.<\/p>\n<p>For a party that controls the majority in the Federal Legislature,<br \/>\nAPC\u2019s gravitas and magisterial \u00e9lan are on the line. Ordinarily, it<br \/>\nshould have its way. But the acts of politicians and their desperate<br \/>\nquest for power and positions are somewhat shrouded in political<br \/>\nstatements that are, at best, apocryphal.\u00a0 I believe stakeholders should<br \/>\nnot resort to circumvention of the rules in a bid to push through<br \/>\ninterests and endorsements.<\/p>\n<p>Instead of circumventing the rules, steps should be taken by the<br \/>\nNational Assembly to amend the rules in accordance with popular<br \/>\naspirations.\u00a0 Usually, every session of the National Assembly has the<br \/>\nliberty to do that.\u00a0 That was the reason the 7th Session of the Senate<br \/>\npurportedly amended the standing orders that the former Clerk to the<br \/>\nNational Assembly (CNA), Salisu Maikasuwa, used to inaugurate the 8th<br \/>\nSession.<\/p>\n<p>The document, tagged: Senate Standing Orders 2015 as amended, comprises<br \/>\nthe extant rules regulating the workings of the Senate.\u00a0 It provides for<br \/>\nsecret ballot and it has yet to be amended.\u00a0 And as long as it has not<br \/>\nbeen amended, it remains the document that will guide the incumbent CNA,<br \/>\nMohammed Ataba Sani-Omolori, in the inauguration of the 9th National<br \/>\nAssembly.<\/p>\n<p>The crux of the procedures is that nomination of senators-elect for<br \/>\nelection as presiding officers shall be addressed to the CNA.<br \/>\nSignificantly, the rule mandates the CNA to take charge and,<br \/>\nspecifically, in Order 3(3)(9e) to proceed in this direction, to wit:<br \/>\n\u201cwhen two or more senators-elect are nominated and seconded as Senate<br \/>\nPresident, the election shall be conducted as follows: (i) by electronic<br \/>\nvoting; or (ii) voting by secret ballot which shall\u00a0 be conducted by the<br \/>\nClerks-at-the Table using the list of the Senators-elect of the Senate,<br \/>\nwho shall each be given a ballot paper to cast his vote, with the<br \/>\nproposers and seconder as Teller.\u201d\u00a0 The same mode applies in the House<br \/>\nof Representatives.<\/p>\n<p>Ostensibly, the APC leadership, acting in concert with the presidency,<br \/>\nis ill-at-ease with the secret ballot mode. It would have loved to see<br \/>\nmembers-elect of the party that will dare to vote against its positions<br \/>\non the floors of the two chambers. But for a member of the 7th National<br \/>\nAssembly, Senator Yisa Braimoh, who represented Edo North on the<br \/>\nplatform of the Peoples Democratic Party (PDP), open ballot should be<br \/>\nadopted.<\/p>\n<p>That was the mode that was adopted on June 5, 2007 in the election that<br \/>\npitted David Mark and George Akume against each other. That was the<br \/>\nfirst and only time open ballot would be adopted in the Fourth Republic<br \/>\nSenate leadership election. Both Mark and Akume belonged to the ruling<br \/>\nPDP. The standing rule was not specific on the election mode. The party,<br \/>\nunder Ahmadu Ali, had informed members-elect that Mark was its candidate<br \/>\nfor senate president and Mulikat Adeola was its candidate for Speaker.<br \/>\nAlthough Mark won in the Senate and Adeola lost to Aminu Tambuwwal who<br \/>\ndared to challenge the party\u2019s decision, Mark\u2019s victory did not go<br \/>\nwithout a strong challenge on the Senate floor.<\/p>\n<p>Incidentally, Braimoh was one of the senators who voted for Akume in the<br \/>\nopen ballot that was adopted, a move that indicated their<br \/>\nindependent-mindedness and courage to differ with the party. He and<br \/>\nother senators who voted for Akume, however, received raw deals from the<br \/>\nMark leadership in appointments into standing and ad-hoc committees. In<br \/>\nretrospect, Braimoh believes he took the right decision. He believes<br \/>\nopen ballot will help to strengthen democracy and independence of the<br \/>\nthree arms of government.<\/p>\n<p>According to him, \u201cthat is why I remain of the firm belief that the<br \/>\nopen ballot system, if adopted, now or permanently, will guarantee the<br \/>\ngenuine wish of Senators-elects (and members-elect) for the emergence of<br \/>\nthe senate leadership. Secret ballot safeguards hypocrisy, disloyalty<br \/>\nand pretence.\u201d\u00a0 As appealing as his position maybe, the fact remains<br \/>\nthat the standing orders of both chambers have yet to be amended and the<br \/>\nCNA, who is a lawyer, will be guided by the rules of both chambers on<br \/>\nthe mode of election contained therein: secret ballot.
