Human rights lawyer, Femi Falana has accused the Economic and Financial<\/div>\n

Crimes Commission (EFCC) of only respecting the rights of influential
\ncriminal suspects.<\/p>\n

Presenting a paper on Wednesday at the 2019 law week of the Nigerian Bar
\nAssociation (NBA), Epe branch, Lagos state, Falana said Nigeria operates
\na double criminal justice system, one for the rich and the other for the
\npoor.<\/p>\n

The senior advocate of Nigeria (SAN) said corrupt politicians and some
\nsenior lawyers have hijacked the criminal justice system, working
\ntogether to frustrate the effective prosecution of corruption cases
\npending in several courts.<\/p>\n

Falana urged \u201cprogressive lawyers\u201d to team up with other patriotic
\nforces to promote equal justice system in the country.<\/p>\n

\u201cApart from two former governors, namely Messrs Joshua Dariye and Jolly
\nNyame, the list of convicted persons is made of lowly-placed individuals
\nin the society,\u201d Falana said.<\/p>\n

\u201cOwing to abuse of court process, rich defendants have continued to
\nfrustrate their prosecution with the connivance of some senior lawyers.<\/p>\n

\u201cBy virtue of section 17 (2) (a) of the Constitution of Nigeria 1999 (as
\namended), every citizen shall have equality of rights, obligations and
\nopportunities before the law. But in practice, the rich and poor
\ndefendants are not treated equally by Nigerian courts. Apart from the
\nfact that rich litigants have the means to hire the services of the best
\nlawyers in any area of the law, the courts are manned by judges who are
\nnot neutral in the class struggle being waged daily by the Nigerian
\npeople.<\/p>\n

\u201cNotwithstanding that the Economic and Financial Crimes Commission
\n(EFCC) has been accused by the bourgeois media of engaging in Gestapo
\ntactics with respect to the treatment of suspects, it cannot be denied
\nthat the rights of influential criminal suspects are well respected by
\nthe commission.<\/p>\n

\u201cThe big men and women implicated in allegations of serious economic
\ncrimes being investigated by the commission usually receive polite
\nletters of invitation, telephone calls or text messages advising them to
\ncontact named investigators whose telephone numbers are supplied.\u201d<\/p>\n

Falana said rich suspects always apply to be kept in EFCC\u2019s cells since
\nthey are much more comfortable than police and prison cells.<\/p>\n

\u201cIf and whenever influential criminal suspects report themselves they
\nare treated with utmost courtesy by the investigators. Since they are
\npresumed innocent until they are proved guilty by the State they are
\nnever paraded before the media, regardless of the gravity of the offence
\ncommitted by them,\u201d Falana said.<\/p>\n

\u201cUnlike what obtains in western countries it is infra dignitate to
\nsubject big men and women to the restraint of handcuff in Nigeria.
\nHence, hell was let loose when a chieftain of the Peoples Democratic
\nParty on trial for money laundering was recently handcuffed by the Kuje
\nprison authorities.<\/p>\n

\u201cA few years ago, the Olusegun Obasanjo administration apologized in
\nwriting to a former police chief who was handcuffed by the EFCC while he
\nwas on trial for money laundering and corrupt practices to the tune of
\nN17 billion.\u201d<\/p>\n<\/div>\n<\/div>\n
