{"id":67209,"date":"2019-06-11T17:12:23","date_gmt":"2019-06-11T16:12:23","guid":{"rendered":"http:\/\/pointblanknews.com\/pbn\/?p=67209"},"modified":"2019-06-11T17:12:23","modified_gmt":"2019-06-11T16:12:23","slug":"cybercrimes-act-will-be-amended-fg","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/news\/cybercrimes-act-will-be-amended-fg\/","title":{"rendered":"\u00a0Cybercrimes Act will be amended&#8212;FG"},"content":{"rendered":"<p>The Federal Government has stated that the Federal Ministry of Justice<br \/>\nis committed to pursuing the amendment of the Cybercrimes Act, which<br \/>\nmany lawyers, journalists and activists have considered repressive,<br \/>\nunconstitutional and illegal.<\/p>\n<p>This was stated today by Mr. Terlumun George Tyendezwa, Head,<br \/>\nCybercrimes Prosecution Unit, Federal Ministry of Justice, at a Media<br \/>\nInteractive Session on the &#8216;Constitutionality and Legality of the<br \/>\nCybercrimes Act in Nigeria&#8217;, organized by the Socio-Economic Rights and<br \/>\nAccountability Project (SERAP) in collaboration with the National<br \/>\nEndowment for Democracy (NED), USA.<\/p>\n<p>At the Media Interactive Session held in Ikeja, Lagos, Mr. Tyendezwa<br \/>\nsaid: &#8220;The Cybercrimes Act is not perfect. One of the reasons why I am<br \/>\nhere is that I have an open door, we want to engage on the Act. We are<br \/>\ninterested in engaging with all stakeholders in the Justice sector.<br \/>\nWhatever is not useful, we can seek amendment on this. From the point of<br \/>\npassage, we as the operators knew that there were things that need to<br \/>\nchange. We are presently collating memoranda on amendment of the Act.<br \/>\nBut amendment takes time and cost money.&#8221;<\/p>\n<p>He also said: &#8220;We know the importance of law as a social driver. The<br \/>\noffice of the Attorney General of the Federation and Minister of Justice<br \/>\ncontinues to place high value on entrenched fundamental human rights and<br \/>\nengaging with all stakeholders on the Cybercrimes Act is one of our<br \/>\napproaches.&#8221;<\/p>\n<p>Earlier at the meeting, a group of lawyers, journalists, activists and<br \/>\nother stakeholders unanimously declared the Nigeria&#8217;s Cybercrimes Act as<br \/>\n&#8220;repressive, oppressive and unconstitutional. The Act should immediately<br \/>\nbe repealed or dropped, as many of its provisions blatantly offend the<br \/>\nrights to freedom of expression, association and media freedom.&#8221;<\/p>\n<p>The group also called on the next Attorney General of the Federation and<br \/>\nMinister of Justice to &#8220;prioritize challenging in court the<br \/>\nconstitutionality and legality of the Cybercrime Act, which is<br \/>\nantithetical to respect for freedom of expression including online and<br \/>\nthe government&#8217;s commitment to fight grand corruption.&#8221;<\/p>\n<p>Participants at the interactive session included: representatives of the<br \/>\nPremium Times Centre for Investigative Journalism (PTCIJ), National<br \/>\nHuman Rights Commission, Amnesty International, Wole Soyinka Center for<br \/>\nInvestigative Journalism, Media Rights Agenda, the German Consulate,<br \/>\nDirector General of the National Orientation Agency.<\/p>\n<p>Others included: Mr. Terlumun George Federal Ministry of Justice,<br \/>\nCybercrimes Act, Nurudeen Ogbara former Chairman Nigerian Bar<br \/>\nAssociation, Ikorodu, Folake Falana, Malachy Ugwummadu, president,<br \/>\nCommittee For the Defence of Human Rights (CDHR) and representatives of<br \/>\nBudgIT, CODE, Heda Resources, Enough is Enough Nigeria (EiE), Cleen<br \/>\nFoundation, Federal Civil Service Pension, Community Life Project,<br \/>\njournalists, lawyers, activists and other stakeholders.<\/p>\n<p>Earlier, Mr Tayo Oyetibo, SAN in his paper titled The Constitutionality<br \/>\nand Legality of the Cybercrimes Act in Nigeria stated: &#8220;the supremacy of<br \/>\nthe constitution over every other law is an immutable principle of<br \/>\nNigerian constitutional law derived from the provisions of section 1(3)<br \/>\nof the constitution itself. In creating criminal offences, section 24(1)<br \/>\nof the Cybercrimes Act uses words that are entirely subjective in<br \/>\nmeaning to describe the actus reus elements of the offences, despite the<br \/>\nfact that the actus reus of an offence ought to be capable of objective<br \/>\nand not subjective definition.&#8221;<\/p>\n<p>According to him, &#8220;Worse still, the Cybercrimes Act makes no effort to<br \/>\ngive certainty to the meanings of any of the words used in its section<br \/>\n24(1) by defining them anywhere in the Act, which means that only<br \/>\njudicial definitions can be given to those words in any case where a<br \/>\nperson is charged with an offence under section 24(1) of the Act.&#8221;<\/p>\n<p>The paper read in part: &#8220;In the context of the constitutionally<br \/>\nguaranteed right of citizens to freedom of speech under the Nigerian<br \/>\nconstitution, there is the pressing question of whether the Cybercrimes<br \/>\nAct is fit for the purpose pursuant to which it was enacted,<br \/>\nparticularly in view of the provisions of its section 24(1)?&#8221;<\/p>\n<p>&#8220;It would appear that the answer to this poser is in the negative, which<br \/>\nmeans that it is imperative for deliberate steps to be taken to remedy<br \/>\nthe situation, particularly against the backdrop of widespread<br \/>\ncomplaints against the deliberate misuse and abuse of the Cybercrimes<br \/>\nAct against certain categories of persons in Nigeria.&#8221;<\/p>\n<p>&#8220;In this regard, this is not a matter in which long winding technical<br \/>\nrecommendations are necessary. The simple recommendation is that section<br \/>\n24(1) be entirely deleted from the Cybercrimes Act, due to its apparent<br \/>\nirreconcilability with the provisions of section 36(12) and 39(1) of the<br \/>\nconstitution.&#8221;<\/p>\n<p>&#8220;From a practical standpoint, it means that a person charged with an<br \/>\noffence under section 24(1) of the Cybercrimes Act will involuntarily be<br \/>\nplaying the lottery of judicial interpretation of the words and phrases<br \/>\nused in that section. This is because virtually all of the words used in<br \/>\nsection 24(1) of the Act are of such personal character that, any<br \/>\nattempt to define them is entirely subject to the whims and caprices of<br \/>\ntwo different sets of people- complainants and judges.&#8221;<\/p>\n<p>&#8220;It is impossible for a person to be convicted of an offence under<br \/>\nsection 24(1) of the Cybercrimes Act without conjecture or inference by<br \/>\nthe court as to the meanings of the words used in that section. Worse<br \/>\nstill, such conjecture or inference can only be imputed by the court at<br \/>\nthe point of delivering judgment in the matter, at which point the<br \/>\naccused person will not have had the opportunity to be heard by the<br \/>\ncourt as to the court&#8217;s interpretation of the meanings of those words<br \/>\nand phrases.&#8221;<\/p>\n<p>&#8220;Apart from the above, every person is constitutionally guaranteed the<br \/>\nright to freedom of expression, including freedom to hold opinions and<br \/>\nto receive and impart ideas and information without interference under<br \/>\nsection 39(1) of the constitution. A scenario in which a person is bound<br \/>\nby section 24(1) of the Cybercrimes Act to second-guess the exercise of<br \/>\nhis right to freedom of expression under section 39(1) of the<br \/>\nconstitution is certainly not one contemplated by the constitution in<br \/>\nany way.&#8221;<\/p>\n<p>&#8220;Freedom of speech and freedom of assembly are part of democratic rights<br \/>\nof every citizen; our legislature must guard these rights jealously as<br \/>\nthey are part of the foundation upon which the government itself rests.&#8221;<\/p>\n<p>&#8220;It is clear that section 24(1) of the Cybercrimes Act portends great<br \/>\ndanger for every person in Nigeria. This is by reason of the fact that<br \/>\nat the time of issuing any communication in exercise of the right to<br \/>\nfreedom of expression, it is impossible for a person to determine<br \/>\nwhether or not an offence is being committed under the Cybercrimes Act.<br \/>\nSurely, this is the exact scenario that the framers of the constitution<br \/>\nsought to legislate against by the inclusion of the express provisions<br \/>\nthat are sections 36(12) and 39(1) of the constitution.&#8221;<\/p>\n<p>&#8220;24(1) is a tool that readily lends itself to abuse and misuse by those<br \/>\nin authority against freedom of expression in Nigeria.
