{"id":67293,"date":"2019-06-25T22:55:14","date_gmt":"2019-06-25T21:55:14","guid":{"rendered":"http:\/\/pointblanknews.com\/pbn\/?p=67293"},"modified":"2019-06-25T22:55:14","modified_gmt":"2019-06-25T21:55:14","slug":"innoson-vs-gtbank-court-issues-warrant-of-arrest-of-innocent-chukwuma","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/news\/innoson-vs-gtbank-court-issues-warrant-of-arrest-of-innocent-chukwuma\/","title":{"rendered":"Innoson Vs GTbank: Court Issues Warrant of Arrest of Innocent\u00a0 Chukwuma"},"content":{"rendered":"<div id=\"m2956018011735866220\" class=\"mail-message expanded\">\n<div class=\"mail-message-content collapsible zoom-normal mail-show-images \">\n<div class=\"clear\">A federal high court in Lagos has issued a bench warrant for the arrest<br \/>\nof Innocent Chukwuma, chief executive officer of Innoson Nigeria Ltd.<\/p>\n<p>Ayokunle Faji, the presiding judge, issued the bench warrant on Monday,<br \/>\nciting Chukwuma\u2019s failure to appear before him over an alleged N2.4<br \/>\nbillion fraud case.<\/p>\n<p>According to NAN, the court also ordered the arrest of two of Chukwuma\u2019s<br \/>\nemployees.<\/p>\n<p>The Innoson CEO is being prosecuted alongside Charles Chukwuma, Maximian<br \/>\nChukwura, Mitsui Osk Lines (MOL), a shipping company and Anajekwu Sunny.<\/p>\n<p>The defendants had been charged to court for their alleged role in<br \/>\nconspiring to unlawfully falsify shipping clearance documents.<\/p>\n<p>They were accused of presenting the falsified shipping documents as<br \/>\ncollateral to Guaranty Trust Bank Plc to obtain a loan of N2.4 billion.<\/p>\n<p>The federal government claimed that the defendants committed the offence<br \/>\nat Apapa Wharf, Lagos, on October 10, 2013.<\/p>\n<p>Abubakar Malami, who was attorney-general of the federation and minister<br \/>\nof justice at the time, had taken over the case.<\/p>\n<p>Julius Ajakaiye, the prosecutor, had said the charge was served on the<br \/>\ndefendants by an order for substituted service on February 8, 2016<br \/>\nfollowing the AGF\u2019s take-over of the case.<\/p>\n<p>Ajakaiye said since then, the third and fourth defendants had been<br \/>\ncoming to court, while the first, second and fifth defendants had<br \/>\nrefused, failed and neglected to appear in court till date.<\/p>\n<p>He had argued that the defendants were yet to take their pleas and so,<br \/>\nshould be compelled to appear.<\/p>\n<p>Ajakaiye had also urged the court to grant his application by ordering<br \/>\ntheir arrest.<\/p>\n<p>The team of defence counsel had on their part, urged the court to<br \/>\ndismiss the application as the defendants were not properly arraigned<br \/>\nbefore the court, adding that the court lacked jurisdiction to do same.<\/p>\n<p>After arguments, the court had then adjourned the case for ruling.<\/p>\n<p>Delivering his ruling, Faji first highlighted the various arguments and<br \/>\nsubmissions as canvassed by respective parties.<\/p>\n<p>He held that it is clear that the first, second and fifth defendant have<br \/>\nnot appeared in the criminal charge and consequently held that the<br \/>\napplication by the prosecution has merit.<\/p>\n<p>\u201cI hereby order as follows: warrant of arrest is hereby issued against<br \/>\nInnocent Chukwuma, Charles Chukwuma and Sunny Anajekwe,\u201d he held.<\/p>\n<p>He then adjourned the case till June 28.<\/p>\n<p>In the charge, the prosecution accused the defendants of conspiring to<br \/>\nunlawfully falsify shipping clearance documents.<\/p>\n<p>They were accused of \u201cuttering\u201d (presenting) the alleged falsified<br \/>\nshipping documents as collateral to Guaranty Trust Bank Plc to allegedly<br \/>\nobtain a loan of N2.4billion.<\/p>\n<p>The prosecution claimed that the defendants committed the offence at<br \/>\nApapa wharf on October 10, 2013.<\/p>\n<p>The alleged offence is contrary to sections 1(2) (c) and 3(6) of the<br \/>\nmiscellaneous offences act, cap M17, laws of the federation 2004.<\/p>\n<\/div>\n<\/div>\n<div class=\"mail-message-footer spacer collapsible\"><\/div>\n<\/div>\n<div id=\"m-4226825875738641325\" class=\"mail-message expanded\"><\/div>\n<!-- AddThis Advanced Settings generic via filter on the_content --><!-- AddThis Share Buttons generic via filter on the_content --><!-- AddThis Related Posts generic via filter on the_content -->","protected":false},"excerpt":{"rendered":"<p>A federal high court in Lagos has issued a bench warrant for the arrest of Innocent Chukwuma, chief executive officer of Innoson Nigeria Ltd.
