{"id":67804,"date":"2019-07-22T08:41:05","date_gmt":"2019-07-22T07:41:05","guid":{"rendered":"http:\/\/pointblanknews.com\/pbn\/?p=67804"},"modified":"2019-07-22T08:41:05","modified_gmt":"2019-07-22T07:41:05","slug":"senate-and-the-politics-of-abbos-inquisition","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/articles-opinions\/senate-and-the-politics-of-abbos-inquisition\/","title":{"rendered":"SENATE AND THE POLITICS OF ABBO\u2019S INQUISITION"},"content":{"rendered":"<div class=\"adn ads\" data-message-id=\"#msg-f:1639714791515873712\" data-legacy-message-id=\"16c16fea5141e1b0\">\n<div class=\"gs\">\n<div class=\"\">\n<div id=\":pd\" class=\"ii gt\">\n<div id=\":nv\" class=\"a3s aXjCH \">By Sufuyan Ojeifo<\/p>\n<p>These have not been the best of times for Senator Elisha Cliff Abbo<br \/>\n(Adamawa South), an otherwise sedate but highly fecund personality, who<br \/>\nhas been in the eye of the storm since a video in which he was seen<br \/>\nslapping a woman attendant in a shop in Abuja went viral, sparking<br \/>\ncountrywide contempt.<\/p>\n<p>The incident, which purportedly happened many months before the<br \/>\ninauguration of the 9th Senate of which he is a first-time member, has<br \/>\nbecome a cause of action in a Magistrate Court, Zuba, where he was<br \/>\ncharged with assault by the Police but granted N5 million bail and two<br \/>\nsureties in like sum, consequent upon his not-guilty plea.<\/p>\n<p>The arraignment of Abbo by the Police is in apple-pie order. The State<br \/>\nshould henceforth be ready to do this and, across-the-board.\u00a0 Abbo\u2019s<br \/>\npublic apology had enabled the Police to establish a prima facie case<br \/>\nagainst him. But his non-guilty plea to the offence presupposed that he<br \/>\nhad justifications for his action.<\/p>\n<p>Therefore, while the senator is in Court to defend the case against him,<br \/>\nevery other extra-judicial intercession becomes restrained and subject<br \/>\nto the Court\u2019s verdict in the matter; otherwise, such intercessions<br \/>\nare sub-judice as their outcomes could be prejudicial to the court\u2019s<br \/>\njudgment.<\/p>\n<p>It is therefore logical to surmise, for instance, that the Senate that<br \/>\nset up a seven-member ad hoc committee, headed by Senator Sam Egwu, to<br \/>\ninvestigate the incident on the basis of alleged misconduct of a member,<br \/>\nis on a mission of incursion into a matter that is already before a<br \/>\ncourt of competent jurisdiction.<\/p>\n<p>The Egwu-led Committee had adverted the attention of the Senate to this<br \/>\nfact in plenary, last week, during which it explained that the judicial<br \/>\nintercession had placed a constraint on Abbo from speaking to the<br \/>\ncommittee without delving into the _res_ of the matter. The Committee<br \/>\nhad thus been unable to make progress and had requested for time<br \/>\nextension in the circumstance.<\/p>\n<p>It was, however, curious that the Senate President, Ahmad Lawan, had<br \/>\nonly acceded to a week\u2019s extension, which was not in any way salutary,<br \/>\ninsisting that the committee\u2019s mandate was to look into the aspect of<br \/>\nmisconduct and not the criminal content of the incident. Lawan\u2019s<br \/>\nposition presents a conundrum that the ad hoc committee must deal before<br \/>\nthe new deadline handed down to it.<\/p>\n<p>How the ad hoc committee will unknot the puzzle remains itself a puzzle.<br \/>\nSenator Abbo, who understands the law and his rights as enshrined in the<br \/>\nConstitution as well as the rules in the Standing Orders of the Senate<br \/>\n2015 (as amended), does not look like someone who will cave in to covert<br \/>\nand overt intimidation and shenanigans by the Committee to make him<br \/>\nspeak on a matter that was already before the court.<\/p>\n<p>Therefore, the point is, how will the ad hoc committee infer or reach a<br \/>\ndecision from findings that are made without hearing directly from the<br \/>\nSenator during the committee\u2019s investigation? Will that not vitiate<br \/>\nthe principle of fair hearing (if Abbo is not heard because of the<br \/>\nconcern of sub-judice) upon which the committee\u2019s decision can be<br \/>\nreviewed and nullified by a court of competent jurisdiction?<\/p>\n<p>The Senate President should be guided to act prudently lest he runs the<br \/>\nrisk of being accused of witch-hunt on the basis of two propositions:<br \/>\none, that Abbo is a member of the opposition Peoples Democratic Party<br \/>\n(PDP) and thus should be sacrificed; and, two, that\u00a0 Abbo nominated<br \/>\nSenator Ali Ndume for the position of Senate President in spite of huge<br \/>\npressure from certain powerful quarters not to do so against his<br \/>\n(Lawan\u2019s) nomination and, therefore, he should be dealt with.<\/p>\n<p>But it is instructive to point out, however, that the 9th Senate, which<br \/>\nhas the powers to investigate and discipline its members for a<br \/>\nmisconduct that brings it to disrepute, is, indeed, investigating a<br \/>\nmisconduct that happened in the life of the 8th Senate when the 9th<br \/>\nSenate had yet to be inaugurated and Abbo had yet to become its bona<br \/>\nfide member.<\/p>\n<p>This then raises the question of whether or not this Senate can extend<br \/>\nits jurisdiction to investigate a member\u2019s conduct that happened in<br \/>\nthe past when it had yet to come into existence. If that retroactive<br \/>\npower is exercisable by the 9th Senate, then it means that a whole lot<br \/>\nof misconduct by some or many or even all members before they became<br \/>\nsenators can be dug up and dealt with in the guise of investigation to<br \/>\nachieve some political ends.<\/p>\n<p>I doubt if this is what the 9th Senate under Lawan wants to bog itself<br \/>\ndown with. If that is not the intention of the leadership of the 9th<br \/>\nSenate, it should then be content with its strategic decision to set up<br \/>\nthe ad hoc committee in deference to the hue and cry by Nigerians. By<br \/>\nsetting up the ad hoc committee, the leadership had succeeded in<br \/>\ndeflecting the avalanche of public criticisms directed at the<br \/>\ninstitution of the Senate, even though the exercise was anchored on some<br \/>\npublic misconception about the incident that happened in the past and<br \/>\nthe position of the protagonist as an incumbent member of the Senate.<\/p>\n<p>The utility of the strategic intervention of the Senate in setting up<br \/>\nthe ad hoc committee should suffice in the circumstance while the Court<br \/>\nis allowed to deal with the overarching criminal aspect of the incident<br \/>\nthat has yet to be statute-barred. The suggestion by the Senate<br \/>\nPresident that the ad hoc committee should sidestep the criminal aspect<br \/>\nand engage with the aspect of misconduct is quixotic. Why the fixation<br \/>\nto do that?<\/p>\n<p>The Senate leadership already stands commended for calming frayed nerves<br \/>\nthrough the emplacement of the committee. It should not slip into<br \/>\ninternal politicking and politics of bias that manifested at the maiden<br \/>\nsitting of the committee when Oluremi Tinubu (APC) threatened Abbo with<br \/>\nthe powers of the committee to recommend for his suspension. That was<br \/>\ntoo sophomoric and imprudent.<\/p>\n<p>Abbo\u2019s riposte, amid the psychological pressures and social tension,<br \/>\nthat the fact that he was before the committee did not amount to waiving<br \/>\nof his rights as a senator was precise; and, it resonated well with<br \/>\nthose who appreciated the sentiments and the context of the politicking<br \/>\nand shenanigans that had coalesced with hidden personal bile, perhaps,<br \/>\nto settle some political scores.<\/p>\n<p>It is also a no-brainer that in the ad-hoc committee that comprises two<br \/>\nwomen &#8211; Tinubu and Uche Ekwunife (PDP) &#8211; feminist sentiments would<br \/>\nnaturally weigh against Abbo.\u00a0 This is just a proposition in the<br \/>\ncircumstance where advocacy for protection of female gender against<br \/>\nperceived male brutalities is a factor that weighs heavily on the scale.<br \/>\nAbbo\u2019s good fortune is that the other members are male.<\/p>\n<p>Besides, there are other considerations that will kick in to influence<br \/>\nrecommendations after findings have been made; that is, after the ad hoc<br \/>\ncommittee had been able to do its proper investigation. Against this<br \/>\nbackdrop, Abbo becomes a circumstantial captive in the \u201ccourt\u201d of<br \/>\nhis colleagues. Regardless that his conduct is the gravamen under the<br \/>\nfocus of the ad hoc committee, it does not disrobe him of his rights as<br \/>\na senator.<\/p>\n<p>Abbo also enjoys the protection of the Court while, in the long run, he<br \/>\nremains bound by whatever the decisions of the Courts are even on<br \/>\nappeal.
