\nHarcourt, Rivers State has convicted and sentenced the trio of Abdullahi
\nYahaya, Suleiman Hassan and Salisu Abubakar\u00a0 to two years imprisonment
\neach and handed a fine of N500,000 ( Five Hundred Thousand Naira only)
\nto one Monday Major for\u00a0 illegal dealing in petroleum products.<\/p>\n
The convicts were arraigned on Monday, July 29, 2019 by the Economic and
\nFinancial Crimes Commission, EFCC, Port Harcourt Zonal Office, on
\none-count separate charge, bordering on illegal dealing in petroleum
\nproducts, contrary to Section 4(1) of the Petroleum Act, Cap P10 Laws of
\nthe Federation of Nigeria (LFN) 2004, and punishable under Section 4(6)
\nof the same Act.<\/p>\n
Trouble began for Yahaya, Hassan and Abubakar when they were intercepted
\nby Nigerian Army, 6 Division, Port Harcourt sometime in June 2019 at
\nAluu General Area, Port Harcourt distributing Automotive Gas Oil
\n(diesel) using a DAF Tanker with registration number FST 12XB without an
\nappropriate license. Major on the other hand, was intercepted
\ndistributing diesel with a Mack Tanker with registration number XP 711
\nPHC without a requisite license.<\/p>\n
The one-count charge reads: “That you Abdullahi Yahaya, Suleiman Hassan
\nand Salisu Abubakar, sometime in June, 2019, in Port Harcourt, Rivers
\nState, within the jurisdiction of this honorable court did distribute
\npetroleum product (Automotive Gas Oil) with DAF Tanker with registration
\nnumber FST 12 XB, without licence and thereby committed an offence
\ncontrary to Section 4(1) of the Petroleum Act, Cap P10 Laws of the
\nFederation of Nigeria (LFN) 2004 and punishable under Section 4(6) of
\nthe same Act.”<\/p>\n
For Monday, his charge reads:\u00a0 “That you Monday Mayor, on or about June,
\n2018, in Port Harcourt, Rivers State within the jurisdiction of this
\nhonourable court did distribute petroleum product (Automotive Gas Oil)
\nwith Mark Tanker XP 711 PHC, without licence and thereby committed an
\noffence contrary to section 4(1) of the Petroleum Act, Cap P10 Laws of
\nthe Federation of Nigeria (LFN) 2004, and punishable under Section 4(6)
\nof the same Act”.<\/p>\n
They all as defendants, pleaded guilty when the charges were read to
\nthem. In view of their pleas, prosecuting counsel, S. Chime prayed the
\ncourt to convict and sentence them accordingly. The defence counsels did
\nnot oppose the prayers of the prosecution.<\/p>\n
Justice Mohammed, accordingly, convicted and sentenced Yahaya, Hassan
\nand Abubakar to two years imprisonment with an option of fine of N50,000
\n(Fifty Thousand Naira) each, while he convicted Major and sentenced him
\nto a fine of N500,000 (Five Hundred Thousand Naira) only. The judge also
\nordered that the petroleum products they were caught with be forfeited
\nto the federal government.<\/p>\n
