The Court of Appeal has upheld the ruling of the Rivers State
\nGovernorship Election Tribunal recognising Mr Henry Bello as the
\nauthentic counsel of the African Action Congress ( AAC) in the appeal
\nfiled by the defeated Rivers State African Action Congress ( AAC)
\nGovernorship Candidate, Biokpomabo Awara.<\/p>\n

The\u00a0 defeated Rivers State African Action Congress ( AAC) Governorship
\nCandidate, Biokpomabo Awara through his counsel, Tawo Tawo (SAN) in suit
\nnumber CA\/PH\/PHT\/356\/2019 urged the Court of Appeal to stop Henry Bello
\nfrom representing the AAC in the Governorship Petition.<\/p>\n

Delivering the lead judgment, Justice Hamma Barka struck out the AAC
\ninterlocutory appeal on the ground that the appellant has no locus to
\nfile the appeal as he is no longer the counsel to AAC.<\/p>\n

The Court of Appeal also ruled that the Appeal filed by the defeated
\nRivers State AAC Governorship Candidate is incompetent, having been
\nfiled without prior leave of court.<\/p>\n

The Court\u00a0 noted that judgement of a court is sacrosanct which all
\nparties are bound to obey. The Court emphasised that AAC has right to
\nchange its counsel based on the judgement of the Federal High Court
\nwhich recognized Leonard Nzenwa as the National Chairman of the party.<\/p>\n

The court recognised counsel of the AAC, Henry Bello filed a preliminary
\nobjection on the premise of section 242 of the constitution of the
\nFederal Republic of Nigeria, 1999 (as amended) , saying\u00a0 that the Appeal
\nis incompetent.<\/p>\n

Counsel to INEC, Sir Steve Adave (SAN), said the decision of the Court
\nof Appeal lays to rest the issue of representation in the suit filed by
\nthe defeated Rivers State AAC Governorship Candidate.<\/p>\n

Counsel to the AAC, Henry Aleruchi of Henry Bello Chambers, said that
\nthe party sacked Omoyele Sowore and elected Leonard Nzenwa who
\nsubsequently appointed\u00a0 Henry Bello as the authentic counsel of the
\nparty.<\/p>\n

He said that the ruling of the Court of Appeal is in consonance with the
\nconstitution, which gives the individuals the right\u00a0 to choose their
\ncounsels.<\/p>\n

In a preliminary objection, Counsel to Rivers State Governor, Nyesom
\nEzenwo Wike, Emmanuel Ukala (SAN) argued that the appellant is not a
\nperson affected by the decision\/ruling of the Tribunal and accordingly
\nhas no locus standi or competence to appeal\u00a0 the judgment of the
\nTribunal.<\/p>\n

Ukala further argued that the Appellant’s\u00a0 Appeal has been mooted and
\nrendered academic by subsequent events including the striking out of the
\nsubstantive appeal by the Tribunal.<\/p>\n

Mark Agwu, who spoke on behalf of\u00a0 Emmanuel\u00a0 Ukala (SAN), counsel to
\nGovernor Nyesom Wike , said the ruling has proved that the appeal is a
\nmere academic exercise and lacks merit.<\/p>\n

“The genesis of the issue was that the petition was filed by the Chamber
\nof Tawo E. Tawo representing both petitioners but in course of the
\nprocessings the AAC decided to debrief the chambers of Tawo E Tawo and
\nengage the chambers of HA Bello to represent it. In the course of that
\nHA Bello fulfilled the condition which you can now change your counsel.<\/p>\n

‘After that Tawo brought an application asking court to set aside the
\nchange of counsel filed by HA Bello after hearing the argument, the
\ntribunal came to the decision that the party deserve its right to engage
\ncounsel of his choice, that is sacrosanct and nobody can change it.
\nPreliminary objection was raised to the effect that AAC now having
\nchanged their counsel Tawo now lacks locus standi to represent it”<\/p>\n

He said that the Court of Appeal has confirmed the ruling of the Federal
\nHigh Court that Leonard Nzenwa is the National Chairman of the AAC<\/p>\n

Counsel to Biokpomabo\u00a0 Awara, Defeated AAC governorship candidate, Mr
\nDavid Adebe of the Tawo Tawo Chambers, said they will study the judgment
\nand decide on the next line of\u00a0 action.<\/p>\n

“The court in their opinion said they did not agree with our view but by
\nthe time our principals consult with the client, then they will decide
\nwhich way forward”, he said.<\/p><\/div>\n<\/div>\n
