The Kaduna State Governorship Election Petition Tribunal has adjourned<\/div>\n
\n
sitting on Monday after counsel adopted their final written addresses
\nand replies to points of law.<\/p>\n

Justice Ibrahim M. Bako, Chairman of the three-member Tribunal, said
\nthat a date would be reserved for judgement and all parties will be
\nnotified through their counsel.<\/p>\n

Recall that the Peoples Democratic Party and its Governorship candidate,
\nIsah Ashiru, had petitioned the March 9 poll in which Governor Nasiru
\nEl-Rufai was returned as duly elected by the Independent National
\nElectoral Commission.<\/p>\n

The Petitioners in their final written address on Monday, asked the
\nTribunal to cancel a total 515, 951 votes which it contended were
\nunlawfully added to the total votes cast during the March 9 poll.<\/p>\n

The petitioners had called 135 witnesses out of the 685 they assembled
\nto prove massive rigging, ballot stuffing and other irregularities
\nduring the poll as contained in their petition.<\/p>\n

The petitioners alleged that INEC had added 391,741 votes to Nasiru
\nEl-Rufai of APC and a total of 124, 210 unlawful votes to the PDP
\nthrough wrong or double entry on the result sheets.<\/p>\n

The PDP and its candidate also contended that declaring El-Rufai winner
\nby INEC was illegal as he did not score majority of lawful votes.<\/p>\n

The PDP through its legal team led Emmanuel C. Ukala (SAN), said
\ndeducting 391,741 votes from 1,045,427 scored by El-Rufai and 124,210
\nfrom Ashiru\u2019s 814, 168 votes will give victory to PDP and Ashiru, its
\ncandidate in the poll.<\/p>\n

The counsel further argued that after the deduction of the alleged
\nunlawful votes, Ashiru will be left with 689,958 lawful votes, while
\nEl-Rufai will have 653,686 votes.<\/p>\n

In his submission, Ukala argued that all parties to the petition are
\nbound to argue their cases on the basis of whether or not the
\npetitioners had assembled credible evidence to sustain their petition,
\nas formulated by the tribunal.<\/p>\n

According to him, \u201conly the 2nd respondent premised his argument on the
\nissues formulated by this honorable tribunal. The 1st and 3rd
\nrespondents went on their own forays.<\/p>\n

\u201cIt is therefore our submission that the argument of the 1st and 3rd
\nrespondents should go to \u2018no issue\u2019, having not addressed the issue
\nwhich was binding to all parties, \u201c Ukala argued.<\/p>\n

The petitioners counsel further said that based on the issues formulated
\nby the tribunal, the issue has been narrowed down to the credibility of
\nevidence.<\/p>\n

\u201cBased on this simplification of the issue, it is our humble submission
\nthat when the evidence led by both sides are placed on the imaginary
\nscales of justice, what is obvious is that the weight of evidence of the
\npetitioners will overwhelmingly weigh in favor of the petitioners as
\nagainst the respondents, \u201c he said.<\/p>\n

\u201cFirst, the petitioners called 135 witnesses. All respondents put
\ntogether, 1st, 2nd and 3rd respondents, called a total of five
\nwitnesses.<\/p>\n

\u201cWhat is obvious is that there were so many areas covered by the
\npetitioners that were not addressed by the respondents.\u201c<\/p>\n

Ukala further pointed out that the quality of the petitioners\u2019 evidence
\nwas more qualitative than that of the respondents with polling unit
\nagents who actually saw what happened on the election day and testified.<\/p>\n

However, in its final written address and reply to points raised by the
\npetitioners, Counsel to APC, Ibrahim Bawa (SAN) said: \u201cour final written
\naddress before the tribunal is that the petitioners have not been able
\nto establish their claim before the court.<\/p>\n

\u201cThere are certain allegations that were made which were criminal.<\/p>\n

\u201cThe petitioners also complain that certain votes were illegally
\nrecorded for the 2nd and 3rd respondents, but unfortunately no evidence
\nwere made to prove those points.<\/p>\n

\u201cSo, we urge the Tribunal to dismiss the petition as the petitioners
\nhave failed to live up to the standard expected of them in proving their
\npetition.\u201d<\/p>\n

Similarly, Abdulhakeem Mustapha, counsel to El-Rufai, the 2nd respondent
\nin the petition, asked the tribunal \u201cto invoke its majestic powers to
\ndismiss the petition as lacking in merit and to confirm that the 2nd
\nrespondent, Malam Nasiru El Rufai as duly elected as governor of Kaduna
\nState on the March 9 election.\u201d<\/p>\n

Mustapha in an interview with newsmen also said: \u201cwe have been able to
\ntell the court that all the witnesses called by the petitioners failed
\nwoefully to prove the ingredient of the fact relied upon in their
\npetition.<\/p>\n

\u201cThe onus is on the petitioners to come with credible evidence and all
\nthe testimonies of the witnesses produced by the petitioners were
\ndemolished under cross examination.<\/p>\n

\u201cThere is nothing that the court will see to be persuaded to give
\njudgment in their favor, we have been able to show with the witnesses we
\ncalled that the election was conducted in conformity with the provision
\nof the electoral Act.<\/p>\n

\u201cWe are very satisfied with the proceedings and we are very sure that
\njustice will be done and sure that Malam Nasiru El-Rufai was duly
\nelected by the people of Kaduna State.<\/p>\n

\u201cOn behalf of the 2nd respondent, the final written address which was
\ndated 2nd August, was filed on 3rd August, 2019, while the 2nd
\nrespondent filed a reply on fact of law on August 16,\u201d Mustapha said.<\/p>\n

Meanwhile, Counsel to the 1st respondent, INEC, Aliyu Umar (SAN) urged
\nthe tribunal to \u201cdismiss the petition and confirm El Rufai as duly
\nelected Governor of Kaduna State.\u201d<\/p>\n

Umar drew the attention of the tribunal to the fact that the petitioners
\nhad just served him with a list of additional authorities on the day of
\nsitting.<\/p>\n

He also told newsmen shortly after the sitting that: \u201cWe told the
\ntribunal to take witnesses of the petitioners one by one and urged the
\ntribunal to hold that their evidence was different from what they
\nalleged in their petition.<\/p>\n

\u201cAnd their witnesses have all confirmed during cross examination that no
\nINEC officials connived with any other person.<\/p>\n

\u201cThe petitioners only called 135 of the 685 witnesses the petitioners
\nsaid they would call, that is short of the number they were supposed to
\ncall to prove their case.<\/p>\n

\u201cThey are to win their case by the evidence presented not by our
\nwitnesses,\u201cUmar said.<\/p>\n

At the end of the sitting, Justice Bako, thanked counsel to all the
\nparties, party members and representatives of the media for their
\ncooperation and publicity through out the hearing.<\/p>\n

The News Agency of Nigeria reports that Khadi Adamu Usman and Justice
\nJude Obiora served as members of the Kaduna State Governorship Election
\nPetition Tribunal.<\/p>\n
