A tribunal sitting in Awka on Friday dismissed a petition filed by All
\nProgressives Grand Alliance (APGA) candidate, Ekene Enefe, against
\nVincent Olumelu of People\u2019s Democratic Party, PDP, for Oyi\/Anyamelum
\nFederal Constituency of\u00a0 Anambra state.<\/p>\n
Vincent was declared winner in the Oyi\/Anyamelum Federal Constituency
\nelection held on 23 February 2019 by Independent Nationalational
\nElectoral Commision (INEC).<\/p>\n
Not satisfied with the outcome of the election, Enefe approached\u00a0 the
\ntribunal seeking the nullification of Vincent\u2019s\u00a0 victory on grounds that
\nmassive votes were allocated beyond the registered numbers.<\/p>\n
He asked the tribunal\u00a0 to declare him winner having scored highest valid
\nvotes.<\/p>\n
Delivering judgement, Justice Olusanya Sunday, who read the judgement,
\nsaid the petitioner failed to prove to the tribunal why it should
\nnullify the election.<\/p>\n
\u201cThe petitioner did not show the manner of voters accruable to him that
\nwas not given or any that was allocated to the respondent.<\/p>\n
The petitioner has the onus to prove his case with facts.<\/p>\n
\u201cHaving not established grounds for nullification of the election, the
\ntribunal has no choice than to\u00a0 \u00a0dismiss petition in entirety and it is
\nhereby dismissed,\u201d\u00a0 he said.<\/p>\n
