Rivers State on Friday 13 September, 2019 ordered a former governor of
\nImo State, Chief Rochas Okorocha and his family not to sell or alienate
\nany of the properties that were subject of an interim order of the court
\npending the conclusion of investigation by the Economic and Financial
\nCrimes Commission, EFCC.<\/p>\n

The Court directed the Applicants to,\u00a0 on or before Tuesday, September
\n17, 2019 deposed to an affidavit of undertaking and adjourned to
\nSeptember 27, 2019 for report.<\/p>\n

The judge gave the Consequential Order while vacating the July 25, 2019
\nInterim Order,\u00a0 forfeiting five properties owned by Okorocha and his
\nfamily to the Federal Government. The properties are:\u00a0 Rochas Foundation
\nCollege, Owerri, All in 1 Shopping Mall, East High Academy,\u00a0 East High
\nCollege and Royal Spring Palm Hotel & Apartments.<\/p>\n

The Registered Trustees of Rochas Foundation College, All-in Limited,
\nRoyal Spring Palm Apartments Limited, Registered Trustees of Women of
\nDivine Destiny Initiative and Uluoma Okorocha Nwosu had challenged the
\norder on August 8, through 5 separate motion on notice praying the Court
\nto vacate the interim forfeiture order.<\/p>\n

The Commission in response filed Counter Affidavits to the motions of
\nthe Applicants on 19 August, 2019.<\/p>\n

On 21 August, 2019 when the case came up for hearing, the Applicants’
\ninformed the court that they were served with the Commission’s Counter
\nAffidavits and asked for an adjournment which was granted by court.<\/p>\n

When the case came up on September 9,\u00a0 2019 for hearing of the Motions,
\nthe Applicants filed Further Affidavits and in reply to these Further
\nAffidavits, the Commission file Counter Affidavits to the Applicants’
\nFurther Affidavit and served them same day.<\/p>\n

However, Applicants’ Counsel Okey Amechi, SAN informed Justice Omotosho
\nthat they were just served and the court adjourned the case to
\nWednesday, September 11, 2019 for hearing.<\/p>\n

After the Court sitting, the Applicants’ served the Commission with 2nd
\nFurther Affidavit at precisely 11:21 am.\u00a0 On Thursday,\u00a0 September12,
\n2019, Counsel to the Commission informed the Court that the Applicants
\nhad served him with their 2ndFurther Affidavits and that he would need
\ntime to respond.The Court gave the Commission till Friday, September,13,
\n2019 to file its Counter Affidavits, failing which it will make a
\nconsequential order. This was after counsel to the applicants had drawn
\nthe attention of the court to the nature of the properties, one of which
\nis a school which was scheduled to resume in September.<\/p>\n

On Friday, September 13, 2019 when the matter came up, Counsel to the
\nCommission informed the Court that he is yet to file its Counter
\nAffidavits and the Court issued the consequential order vis-\u00e0-vis the
\nnature of the properties involved.<\/p>\n

The Commission is studying the consequential order of court.<\/p><\/div>\n<\/div>\n
