The Federal High Court sitting in Yenagoa, Bayelsa State, has ordered
\nsubstituted service on the All Progressives Congress (APC), its
\ncandidate, David Lyon.<\/p>\n
The court also ordered a substitute service on the Independent National
\nElectoral Commission (INEC) in the November 16 governorship election.<\/p>\n
The court presided over by Justice Jane Iyang, gave the directive to a
\nformer Minister of State for Agriculture and Rural Development, Senator
\nHeineken Lokpobiri, in a case he filed against the party, challenging
\nthe primary election that led to the emergence of Lyon.<\/p>\n
At the preliminary hearing of the suit, Justice Iyang granted the
\nexparte motion for substituted service and three other reliefs sought by
\nLokpobiri, who was an aspirant in the party\u2019s September 4 primary
\nelection.<\/p>\n
Justice Iyang, however, declined to issue an order of abridgement of
\ntime, which required the defence to enter appearance, file and serve
\ntheir respective defence process within seven days following the
\nplaintiff\u2019s prayer that the matter required an accelerated hearing.<\/p>\n
She said the plaintiff could not unilaterally abridge the time of
\nresponse of the defence\u2019s lawyer.<\/p>\n
Iyang said following the argument by the plaintiff\u2019s lawyer, Mister
\nFitzgerald Olorogun that the respondents were running away from being
\nserved, the service should be done by pasting the document on the wall.<\/p>\n
She ordered that Lyon be served by pasting the service on the campaign
\nsecretariat along Isaac Boro Expressway, while INEC\u2019s copy should be
\npasted on its secretariat along Swali Road.<\/p>\n
