EFCC, Lagos office, today,<br \/>\nOctober 15, 2019 re-arraigned a lawyer to the former Vice President and<br \/>\nPresidential Candidate of the Peoples Democratic Party, PDP in the last<br \/>\ngeneral election,\u00a0 Atiku\u00a0 Abubakar,\u00a0 Uyiekpen Osagie-Giwa and his son,<br \/>\nErhunse Giwa-Osagie before Justice Chuka Austine Obiozor of the Federal<br \/>\nHigh Court, Ikoyi on a three-count charge bordering on money laundering<br \/>\nto the tune of $2, 000, 000 (Two million United States Dollars).<\/p>\n<p>The duo was first arraigned before Justice Nicholas Oweibo for\u00a0 the same<br \/>\ncharges on the 14th of August, 2019 which they both pleaded not guilty.<br \/>\nThey were re-arraigned today because the matter was brought before<br \/>\nanother judge.<\/p>\n<p>At today&#8217;s proceedings, the lead counsel to the first and second<br \/>\ndefendants, Ahmed Raji (SAN) and Quarkers Norrison (SAN) were<br \/>\nrepresented by Johnson Samuel and Olufemi Anjorin respectively.\u00a0 They<br \/>\napplied in writing\u00a0 to the court to adjourn the matter on grounds that<br \/>\nthe lead counsel for both defendants were not in the court .<\/p>\n<p>They\u00a0 informed the court that a letter had been written to the<br \/>\nadministrative Judge of the Federal High Court, Ikoyi, seeking directive<br \/>\nto consolidate the case as same charges were filed\u00a0 against the<br \/>\ndefendants\u00a0 before both Justice Obiozor and Justice Chukwujekwu Aneke<\/p>\n<p>The prosecution counsel, Kufre Uduak, who held brief for Rotimi Oyedepo<br \/>\nconfirmed the receipt of the &#8216;consolidation letter&#8217; and the<br \/>\napplications for adjournment .<\/p>\n<p>However, he told the court that the plea was to be taken by the<br \/>\ndefendants and not their counsels, adding that, &#8220;absence of lead counsel<br \/>\nshould not stall proceedings given the fact that they are represented in<br \/>\ncourt.&#8221;<\/p>\n<p>&#8220;There was no concrete basis for the defence counsel to seek the<br \/>\nadministrative judge&#8217;s permission for consolidation of the case&#8221;, Kufre<br \/>\ntold the court<\/p>\n<p>&#8220;The matter before Justice Oweibo is not in any way related to the case<br \/>\nbrought before your lordship, and does not require any form of<br \/>\nconsolidation&#8221;, he said.<\/p>\n<p>Justice Obiozor, however, overruled the prayers of the defence for<br \/>\nadjournment and ordered that the defendants take their plea.<\/p>\n<p>He however held that the court cannot predetermine the decision of the<br \/>\nadministrative judge on the consolidation of the cases.<\/p>\n<p>&#8220;The court has to wait to hear from the administrative judge on<br \/>\nconsolidation but however the defendants shall take their plea&#8221;, Justice<br \/>\nObiozor ruled.<\/p>\n<p>The defendants took their plea as ordered by the court and pleaded not<br \/>\nguilty to the charge.<\/p>\n<p>One of the charges read, &#8220;That you Uyiekpen Giwa-Osagie and Erhunse<br \/>\nGiwa-Osagie sometime in February, 2019 in Nigeria, within the<br \/>\njurisdiction of this Honourable Court, considered to commit an offence<br \/>\nto wit: making cash payment of the sum of $2, 000, 000 (Two Million<br \/>\nUnited States Dollars) without going through a financial institution,<br \/>\nwhich sum exceeded the amount authorised by law and you thereby<br \/>\ncommitted an offence contrary to Section 18(a), and 1(a) of the Money<br \/>\nLaundering (Prohibition) Act, 2011 as amended and punishable under<br \/>\nSection 16(b) of the same Act.&#8221;<\/p>\n<p>In view of their plea, the prosecution counsel, Kufre, asked for a trial<br \/>\ndate.<\/p>\n<p>Counsel to the defendants urged the court to allow their clients<br \/>\ncontinue to enjoy the bail terms and conditions granted by Justice<br \/>\nOweibo.<\/p>\n<p>Justice Obiozor acceded to the request of the defendants adjourned the<br \/>\ncase to December 5, 2019 for possible hearing as parties await the<br \/>\ndecision of the administrative judge on consolidation.<\/p>\n<div
