{"id":70267,"date":"2019-11-04T20:16:48","date_gmt":"2019-11-04T19:16:48","guid":{"rendered":"http:\/\/pointblanknews.com\/pbn\/?p=70267"},"modified":"2019-11-04T20:16:48","modified_gmt":"2019-11-04T19:16:48","slug":"appeal-court-sacks-house-leader","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/other-news\/appeal-court-sacks-house-leader\/","title":{"rendered":"Appeal Court Sacks House Leader"},"content":{"rendered":"<div id=\"m-4239164683617683733\" class=\"mail-message expanded\">\n<div class=\"mail-message-header spacer\"><\/div>\n<div class=\"mail-message-content collapsible zoom-normal mail-show-images \">\n<div class=\"clear\">\n<div dir=\"auto\">\n<p>The Court of Appeal sitting in Kaduna on Monday sacked a member representing Tudunwada\/Doguwa Federal Constituency, Alhassan Ado Doguwa.<\/p>\n<p>Mr Doguwa, who is the Majority Leader of the House, is the third ranking member of the House after Speaker and Deputy Speaker.<\/p>\n<div><\/div>\n<p>Recall that on September 5, the election petition tribunal sitting in Kano dismissed a petition filed by the candidate of the Peoples Democratic Party, PDP, Yusha\u2019u Salisu, against Mr Doguwa\u2019s election.<\/p>\n<div><\/div>\n<p>The tribunal said the PDP candidate failed to prove allegations of irregularities and over-voting in the election.<\/p>\n<p>But in a unanimous judgment delivered by Justice Oludotun Adefope-Okojie, the Court of Appeal wondered how the tribunal arrived at the conclusion that PDP and its candidate had failed to prove their case.<\/p>\n<p>While setting aside the tribunal judgement, the court nullified the entire election in the two local government areas Mr Doguwa represents as the whole process was marred by irregularities.<\/p>\n<div><\/div>\n<p>The appellate court held that the entire election could not stand as Independent National Electoral Commission, INEC, had omitted other parties from the final declaration of the result.<\/p>\n<div><\/div>\n<p>The court said INEC made a substantial breach by writing the results of only two parties out of 53 parties that participated in the election in Form EC 8 (II) E.<\/p>\n<p>The court therefore ordered INEC to conduct fresh election within 90 days in the entire constituency.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"mail-message-footer spacer collapsible\"><\/div>\n<\/div>\n<div id=\"conversation-footer\" class=\"spacer\"><\/div>\n<!-- AddThis Advanced Settings generic via filter on the_content --><!-- AddThis Share Buttons generic via filter on the_content --><!-- AddThis Related Posts generic via filter on the_content -->","protected":false},"excerpt":{"rendered":"<p>The Court of Appeal sitting in Kaduna on Monday sacked a member representing Tudunwada\/Doguwa Federal Constituency, Alhassan Ado Doguwa.
