Socio-Economic Rights and Accountability Project (SERAP) has sent an<\/div>\n
\n
open letter to Mrs Soyata Maiga, Chairperson of the African Commission
\non Human and Peoples’ Rights and the commission’s members requesting
\nthem: “to urgently intervene and put pressure on the Nigerian
\nauthorities and their agents to immediately end the intimidation and
\nharassment of detained journalist and activist Omoyele Sowore and
\nOlawale Bakare, their sureties and lawyers, particularly Femi Falana,
\nSAN simply for defending their clients’ rights.”<\/p>\n

According to SERAP, “Nigeria’s State Security Service (SSS) has stated
\nthat it would not release the activists until it is allowed to vet
\nsureties that have already been verified by the court, implicitly
\nharassing the sureties apparently with the aim of pushing them to disown
\nthe detained activists. Similarly, a group of apparently sponsored
\n‘protesters’ calling themselves ‘Save Nigeria Movement’ asked Femi
\nFalana to ‘stop intimidating security agencies.'”<\/p>\n

In the petition dated 22 November 2019 and signed by SERAP deputy
\ndirector Kolawole Oluwadare, the organization said: “The harassment of
\ndetained activists for demanding strict compliance with court orders,
\nand then their sureties as well as lawyers who come to their defence,
\nshows a steady slide away from the rule of law and underscores the
\nurgent need for the Commission to insist on the restoration of respect
\nfor human rights in Nigeria.”<\/p>\n

SERAP also said: “The harassment is emblematic of a broader pattern of
\nofficial threats to and harassment of Nigerian civil society. We are
\nconcerned that rather than releasing Sowore and Bakare as ordered by the
\ncourt, the Nigerian authorities are now implicitly intimidating the
\nactivists, sureties, and lawyers, particularly Femi Falana.”<\/p>\n

The letter copied to Mr. Diego GARC\u00cdA-SAY\u00c1N, UN Special Rapporteur on
\nthe independence of judges and lawyers, read in part: “Apparently
\nsponsored attacks, harassment and intimidation of sureties and lawyers
\nfor doing their independent duties undermine and erode the integrity of
\nthe legal profession, access to justice, Nigerians’ confidence in the
\ncourts, and make a mockery of the entire justice system.”<\/p>\n

“The harassment is emblematic of a broader pattern of official threats
\nto and harassment of Nigerian civil society. SERAP is seriously
\nconcerned that rather than releasing Sowore and Bakare as ordered by the
\ncourt, the Nigerian authorities are now implicitly intimidating the
\nactivists, sureties, and lawyers.”<\/p>\n

“SERAP condemns the use of apparently sponsored protesters to harass and
\nintimidate Sowore and Bakare’s lawyers particularly Femi Falana. The
\nintimidation and harassment of Sowore and Bakare’s legal team is
\nintended to, and will most likely lead to, other lawyers being unwilling
\nto defend anyone facing politically motivated and high-profile
\nprosecutions.”<\/p>\n

“Sureties and lawyers are essential to ensure the effective operation of
\nthe justice system, and the rule of law; they need to be protected not
\nharassed and intimidated. Lawyers ought to have the freedom to carry out
\ntheir legal work and should never have to suffer any intimidation and
\nharassment for discharging their professional duties.”<\/p>\n

“These actions hinder the ability of lawyers to freely carry out their
\nprofessional duties and severely restrict access to justice and fair
\ntrials for the detainees, with a consequent erosion of fair
\nadministration of justice, equality of arms, and the rule of law. By
\ntargeting the detainees’ sureties and lawyers, the Nigerian authorities
\nare implicitly harassing and denying them their right to claim justice.”<\/p>\n

“Sowore and Bakare were arrested simply for calling a national protest.
\nAmnesty International has declared them prisoners of conscience detained
\nsolely for exercising their right to freedom of expression. Sowore,
\nBakare, their sureties and lawyers particularly Femi Falana continue to
\nface hostility, intimidation and harassment.”<\/p>\n

“As one of the main actors of an independent justice system, lawyers
\nhave an essential role to play in protecting human rights, in particular
\ndue process and fair trial guarantees, and ultimately contribute greatly
\nto ensuring respect for the rule of law.”<\/p>\n

“The UN Declaration on Human Rights Defenders affirms the right of
\neveryone peacefully to oppose human rights violations. It prohibits
\nretaliation, threats and other harassment against anyone who takes
\npeaceful action against human rights violations, both within and beyond
\nthe exercise of their professional duties.”<\/p>\n

“Similarly, the UN Basic Principles on the Role of Lawyers provide that
\ngovernments are to ensure that lawyers are able to perform their
\nprofessional functions without intimidation, hindrance, harassment or
\nimproper interference.”<\/p>\n

“Further, the African Charter on Human and Peoples’ Rights to which
\nNigeria is a state party guarantees the right to freedom of expression;
\nthe prohibition of arbitrary detention and the right to a fair trial and
\ndue process of law. Nigeria is also a state party to the International
\nCovenant on Civil and Political Rights, which in Article 14 guarantees
\nthe right of the clients of the concerned lawyers to an effective
\ndefense.”<\/p>\n

“Nigeria’s State Security Service (SSS) has continued to refuse to
\nrelease Omoyele Sowore and Olawale Bakare despite court orders.”<\/p>\n

“The SSS has stated that it would not release the activists until it is
\nallowed to vet sureties that have already been verified by the court,
\nimplicitly harassing and intimidating the sureties and by extension, the
\ndetainees and their lawyers, particularly Femi Falana, apparently with
\nthe aim of pushing the sureties to disown the detained activists, and Mr
\nFalana to withdraw from the suit. However, under Nigerian law, the SSS
\ndoes not have any power to vet sureties.”<\/p>\n

“Also, a group of apparently sponsored ‘protesters’ calling itself ‘Save
\nNigeria Movement’, asked Femi Falana to ‘stop intimidating security
\nagencies.’ The group recently held a rally in Abuja to say ‘enough is
\nenough’ to Femi Falana. The group held up banners conveying their
\nremonstrances such as\u2014’Falana stop blackmailing Nigerian military’ and
\n‘Falana enough is enough’.”<\/p>\n

SERAP therefore urged Mrs Maiga and the commission’s members to urgently
\nput pressure on the Nigerian authorities to:<\/p>\n

1.\u00a0 \u00a0 Stop apparently targeted harassment and intimidation of Sowore,
\nBakare, their sureties and lawyers particularly Femi Falana, and those
\nworking closely with them;<\/p>\n

2.\u00a0 \u00a0 Take measures to protect sureties and lawyers so that they can
\nperform their duties without intimidation, harassment. or improper
\ninterference;<\/p>\n

3.\u00a0 \u00a0 Immediately release Sowore and Bakare as ordered by the court;<\/p>\n

4.\u00a0 \u00a0 Promptly, thoroughly and effectively investigate the allegations
\nof harassment and intimidation of detained activists, their sureties and
\nlawyers and to identify and bring to justice those suspected to be
\ninvolved;<\/p>\n

5.\u00a0 \u00a0 Take prompt and effective measures to ensure the safety and
\nindependence of Femi Falana and members of his legal team<\/p>\n<\/div>\n<\/div>\n
