Former Governor Emeka Ihedioha of Imo State, who was removed by a<\/div>\n
\n
judgement of the Supreme Court, has filed for review of the judgment of
\nthe apex court that sacked him.<\/p>\n

Ihedioha posited that Hope Uzodinma, incumbent governor of Imo,
\nfraudulently misled the court to pronounce him as winner of the
\nelection, adding that the judgment should be nullified.<\/p>\n

Ihedioha, who is seeking \u201can order setting aside as a nullity the
\njudgment delivered by the court\u201d, founded his application on the ground
\nthat the Court of Appeal had earlier dismissed the petition of Uzodinma
\nas incompetent and struck it out.<\/p>\n

He added that while the Supreme Court did not consider the appeal of
\nUzodinma on this point, the judgment of the Court of Appeal dismissing
\nthe petition still stands, adding that there was no basis for the apex
\ncourt to pronounce the appeal and declare Uzodinma as the winner.<\/p>\n

In his application, Ihedioha also noted that, \u201cThe judgment was
\ndelivered without jurisdiction in that by virtue of S.140(2) of the
\nElectoral Act, once the court says that the election was invalid, the
\nonly possible judgment the court is allowed to give is a nullification
\nof the election, and not to declare Hope Uzodinma winner.<\/p>\n

\u201cThat there was no proof before the court nor did the Supreme Court
\nstate how it arrived at the declaration that Hope Uzodinma met the
\nconstitutionally required geographical spread. “To meet this
\nrequirement, the Supreme Court ought to state the scores and percentages
\nof all the 70 candidates that contested the election, local government
\nby local government.<\/p>\n

“This was not done by the Supreme Court and therefore had no basis and
\njurisdiction to declare Hope Uzodinma winner of the election.<\/p>\n

\u201cThat the judgment was a nullity having been obtained by fraud or deceit
\nin that Hope Uzodinma fraudulently misled the Supreme Court into holding
\nthat a total of 213,495 were unlawfully excluded from his votes.<\/p>\n

“The fraud was further orchestrated by the fact that the total votes
\ncast was more than the number of voters accredited to vote. The fraud
\nwas further demonstrated by the document tendered by INEC (FORM EC40G)
\nwhich clearly showed that there were no valid elections in the disputed
\n388 polling units.<\/p>\n

\u201cThat the judgment was a nullity because it was given per incuriam,
\nwhich means that the Supreme Court did not take its attention to some
\nexisting laws and facts even on the face of the proceedings.\u201d<\/p>\n

Ihedioha also posited that with the declaration of the court, the number
\nof votes have exceeded the number of accredited voters.<\/p>\n

He noted that the present application was not subject to the 60 days
\nlimitation period in section 285(7) of the constitution \u201cbecause an
\napplication to set aside a null judgment or order is not circumscribed
\nby statutes of limitation, and section 285 (7) of the constitution is,
\nto all intents and purposes, a statute of limitation.\u201d<\/p>\n

He urged the apex court to nullify its previous judgment and clean
\nitself of corruption by acting in line with the law by pronouncing him
\nwinner of the election.<\/p>\n

Ihedioha said, \u201cJustices of this court are human beings capable of
\nerring.<\/p>\n

\u201cThis court has the power to overrule itself (and has done so in the
\npast) for it gladly accepts that it is far better to admit an error than
\nto preserve an error.<\/p>\n

\u201cAt this, of all times, our Supreme Court has been afforded this unique
\nopportunity of allaying the fears of those who cast aspersions on the
\ncredibility of our courts.<\/p>\n

\u201cYour verdict on this matter should match the solemn oath you have
\ntaken. Remember that every decision of the Supreme Court involves the
\ngood name of the judiciary.<\/p>\n

\u201cProve to the world that the Supreme Court is sacred. Let your verdict
\nhelp to retain the good graces of our people.\u201d<\/p>\n

Uzodinma, who was declared governor of Imo on January 14 by the Supreme
\nCourt, said that he would no longer condone protests calling his
\nemergence.<\/p>\n

He said, \u201cMy government will do all within the ambits of the law to
\nmaintain peace and order; those who are engaging in these incessant
\nprotests must stop forthwith.<\/p>\n

“I took an oath to maintain peace and protect the lives and property of
\nthe citizens, I will not fail to deal with any group causing a breach of
\nthe peace in the state.\u201d<\/p><\/div>\n<\/div>\n
