be arraigned April 2 over alleged N135b fraud as prosecutor accuses him
\nof evading service.<\/p>\n

A Federal High Court sitting in Lagos has fixed April 2 for the
\narraignment\u00a0 of the senator who is also Chairman of Capital Oil and Gas
\nLimited over alleged N135 billion fraud.<\/p>\n

Ubah will be arraigned alongside his company for defrauding the Asset
\nManagement Company of Nigeria [AMCON].
\nThe Anambra-born businessman, who has publicly denied the allegation,
\nwas due for arraignment last December 4, on a four counts charge, but
\nwas absent.<\/p>\n

The prosecuting counsel had filed an ex parte application seeking
\npermission for the court\u2019s balliff to serve Ubah the charge through his
\nlawyer, Dr. Olisa Agbakoba, SAN, as he is allegedly evading service.<\/p>\n

The counsel, in the application supported by an affidavit sworn to by
\nHaleemah Adegoke, averred that Haleemah tried to effect service of the
\ncharge on Ubah personally in December, 2019 at Capital Oil and Gas
\nIndustries\u2019 registered office, but was unable to serve him personally.
\nIn a short ruling, Judge Oweibo granted Adegoke\u2019s prayer.<\/p><\/div>\n<\/div>\n

\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0Court Adjourns Ize-Iyamu’s Trial to Mar 2<\/p>\n

Justice M. G. Umar of a Federal High Court, Benin City, Edo State has
\nadjourned the trial of Pastor Osagie Ize-Iyamu, a former governorship
\ncandidate of the Peoples Democratic Party, PDP in the state to March 2,
\n2020.<\/p>\n

Ize-Iyamu, is being prosecuted by the Economic and Financial Crimes
\nCommission, EFCC, alongside Lucky Imasuen, former deputy governor of Edo
\nState, Chief Dan Orbih, PDP chairman in Edo State; Tony Aziegbemi and
\nEfe Erimuoghae.<\/p>\n

At today’s sitting, the case was stalled due to the absence of the fifth
\ndefendant, Erimuoghae who was said to be ill.<\/p>\n

Counsel for the EFCC, Larry Peters Aso, told the court that he was
\nshocked that Erimuoghae’s counsel wrote a letter to the court seeking
\nthat the case be adjourned to June.<\/p>\n

He said: “It is a ploy to frustrate the trial.<\/p>\n

“His counsel told me that his client would not be in court due to
\nillness but to request for a six months adjournment should be
\ndisregarded.”<\/p>\n

Counsel for the first defendant, K. O. Obamugie asked the court to
\nadjourn for a reasonable length of time to enable the defendant recover
\nproperly in order to be able to face his trial. The same argument was
\ncanvassed by Professor O. G. Izevbuwa, counsel for the second defendant.<\/p>\n

However, Justice Umar adjourned the case to March 2, 2020 and ordered
\nthat the defendant should do all that is necessary to be in court on the
\nadjourned date.<\/p>\n

It will be recalled that they were first arraigned before Justice P. I.
\nAjoku on an eight-count charge bordering on money laundering on May 24,
\n2018.
\nThey were alleged to have sometime in March 2015, in Benin City directly
\ntaken possession of the sum of N700million without any contract award
\nwhich sum was allegedly part of proceeds of an unlawful act, to wit:
\nfraud and corruption.<\/p>\n

One of the counts reads: “That you, Pastor Osagie Ize-Iyamu, Lucky
\nImasuen, Tony Azigbemi, Chief Dan Orbih, Efe Erimuoghae Anthony and
\nChief Anthony Anenih (now at large) sometime in March 2015 in Benin,
\nwithin the jurisdiction of this Honourable Court did directly take
\npossession and control of the sum of N700,000,000.00 (Seven Hundred
\nMillion Naira) only, without any contract award which sum you reasonably
\nought to have known form part of proceeds of an unlawful act, to wit;
\nfraud and corruption; and thereby committed an offence contrary to
\nSection 15(2)(d) of the Money Laundering (Prohibition) Act 2011 (as
\namended by the Money Laundering (Prohibition) Amendment Act 2012 and
\npunishable under Section 15(3)of the same Act.”<\/p><\/div>\n<\/div>\n
