{"id":72005,"date":"2020-03-02T18:14:22","date_gmt":"2020-03-02T17:14:22","guid":{"rendered":"http:\/\/pointblanknews.com\/pbn\/?p=72005"},"modified":"2020-03-02T18:14:22","modified_gmt":"2020-03-02T17:14:22","slug":"immunity-for-lawmakers-will-leave-buharis-anti-corruption-agenda-in-tatters","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/articles-opinions\/immunity-for-lawmakers-will-leave-buharis-anti-corruption-agenda-in-tatters\/","title":{"rendered":"IMMUNITY FOR LAWMAKERS WILL LEAVE BUHARI\u2019S ANTI-CORRUPTION AGENDA IN TATTERS"},"content":{"rendered":"<div id=\"m#msg-f:1660069341640561651\" class=\"mail-message expanded\">\n<div class=\"mail-message-header spacer\">BY KOLAWOLE OLANIYAN<\/div>\n<div class=\"mail-message-content collapsible zoom-normal mail-show-images \">\n<div class=\"clear\">\nWhen Nigeria\u2019s President Muhammadu Buhari was named by the African<br \/>\nUnion as its first \u201canti-corruption champion in Africa\u201d in 2018, he<br \/>\ncalled on member states to \u201cinvest in institutions to entrench<br \/>\ntransparency and accountability.\u201d But the recent push by many<br \/>\nlawmakers from his All Progressives Congress (APC) party to grant<br \/>\nthemselves immunity from prosecution for corruption would seem to leave<br \/>\nMr Buhari\u2019s national commitment to tackle corruption in tatters and<br \/>\nfatally undermined.<\/p>\n<p>The bill, known as \u201cBill for an Act to Alter Section 308 of the<br \/>\nConstitution of the Federal Republic of Nigeria, 1999 to Extend Immunity<br \/>\nto Cover Presiding Officers of Legislative Institutions,\u201d has passed<br \/>\nthe second reading at the House of Representatives. It seeks to amend<br \/>\nSection 308 of the constitution to extend immunity to all the principal<br \/>\nofficers at the country\u2019s National Assembly and the houses of assembly<br \/>\nof the states while in office.<\/p>\n<p>Briefly, Section 308 provides that: \u201cno civil or criminal proceedings<br \/>\nshall be instituted or continued against the President, Vice President,<br \/>\nGovernors and Deputy Governors during their period of office.\u201d<\/p>\n<p>The proposed amendment to Section 308 to cover the lawmakers would mean<br \/>\nthat any criminal or civil action for crime of corruption or other<br \/>\negregious crimes they commit while in office would be stayed until the<br \/>\nexpiration of their tenure.<\/p>\n<p>The bill first appeared in parliament in 2016 but the lawmakers then<br \/>\nbacktracked after a public outcry over the move.<\/p>\n<p>In effect, the bill will protect lawmakers from legal consequences for<br \/>\ncorruption, exacerbate the impunity that prevails in Nigeria\u2019s<br \/>\npolitical circles and worsen the country\u2019s ranking in Transparency<br \/>\nInternational\u2019s Corruption Perception Index. And this would have a<br \/>\nnegative effect on the human rights of Nigerians.<\/p>\n<p>Since the return of democracy in 1999, several politicians\u2014including<br \/>\ngovernors with allegations of corruption against them \u2014 have sought to<br \/>\nhide out in the National Assembly. The proposed bill will now make them<br \/>\nalmost untouchable once they swear their oath of office as lawmakers.<\/p>\n<p>Some lawmakers, including the sponsor of the bill, Odebunmi Olusegun of<br \/>\nOgo-Oluwa\/Surulere federal constituency (APC, Oyo), and at least two<br \/>\nmembers of the opposition People&#8217;s Democratic Party (PDP)\u2014Toby<br \/>\nOkechukwu (PDP, Enugu) and Nkem-Abonta Uzoma (PDP, Abia) \u2014believe that<br \/>\nthe bill will protect them from \u201cblackmail\u201d while in office; that<br \/>\nfear is misplaced.<\/p>\n<p>The lawmakers are already covered by parliamentary immunity under the<br \/>\nLegislative Houses (Powers and Privileges) Act, 2018, which means they<br \/>\nare immune from civil or criminal proceedings for anything they say in<br \/>\nparliament.<\/p>\n<p>This is a privilege developed to ensure open and fearless debate in<br \/>\nParliament and is similar to the situation of lawmakers in the US and<br \/>\nUK, where members of Parliament cannot be sued for defamation for<br \/>\nstatements made in Parliament, which Nigerian politicians frequently<br \/>\ncite as \u201cbest practices.\u201d<\/p>\n<p>However, this Act doesn\u2019t shield lawmakers from prosecution for crime<br \/>\nof corruption or other egregious crimes. The proposed amendment to<br \/>\nSection 308 would now extend the immunity provided under the Act to<br \/>\nshield lawmakers from criminal and civil proceedings, far beyond<br \/>\nexisting Parliamentary privileges and immunities.<\/p>\n<p>The push for immunity for lawmakers ignores the history and legacy of<br \/>\ncorruption in Nigeria and its impact on human rights. It\u2019s also at<br \/>\nodds with Nigeria\u2019s international commitments as a member of the<br \/>\nUnited Nations and the Commonwealth.<\/p>\n<p>There is no legal justification to provide immunity to lawmakers beyond<br \/>\nthe privileges they already enjoy, as to do so would be antithetical to<br \/>\nthe fundamental principle that all persons are equal before the law, and<br \/>\nto Nigeria\u2019s voluntary obligations under the UN Convention against<br \/>\nCorruption, which in article 30(2) requires states parties to limit<br \/>\nimmunity from investigation, prosecution or adjudication of corruption<br \/>\noffences.<\/p>\n<p>Similarly, the Commonwealth Working Group on the Recovery and<br \/>\nRepatriation of Assets of Illicit Origin has stated that Heads of<br \/>\nState\/Government, ministers and other public officials should not have<br \/>\nimmunity from prosecution for alleged criminal activity.<\/p>\n<p>Lawmakers also argue that if the president, his deputy, state governors<br \/>\nand their deputies can enjoy immunity, there is no reason why they<br \/>\nshould not also enjoy immunity. But it\u2019s difficult to see how granting<br \/>\nimmunity to lawmakers will aid the fight against grand corruption in the<br \/>\ncountry.<\/p>\n<p>The lawmakers\u2019 \u201clevelling up\u201d strategy is in fact<br \/>\ncounter-productive, as section 308 of the Constitution is already shown<br \/>\nto impede disproportionately the conduct of inquiries, prosecutions and<br \/>\nthe sentencing of the persons it covers, and thereby contributing to the<br \/>\nprevailing impunity of politicians for corruption.<\/p>\n<p>Lawmakers\u2019 immunity from prosecution for corruption would fuel<br \/>\nperceptions that those charged with the responsibility to make laws for<br \/>\nthe country are seeking to use their position to stay one step ahead of<br \/>\nthe law.<\/p>\n<p>Rather than trying to \u201clevel up\u201d with the executive\u2014at both the<br \/>\nfederal and state levels\u2014members of the House of Representatives<br \/>\nshould push to exclude section 308 or limit its application to cases of<br \/>\ncorruption and other similar crimes that have an impact on human rights.<br \/>\nDoing this will prompt real change in the country\u2019s political culture<br \/>\nand help to improve the lawmakers\u2019 image with Nigerians.<\/p>\n<p>If the bill is passed, it will constrain the ability of Mr Buhari\u2019s<br \/>\ngovernment to fight corruption, as it will mean that lawmakers will see<br \/>\nexpanded opportunities to line their pockets and divert scant public<br \/>\nresources through, for example, the so-called \u201cConstituency<br \/>\nProjects\u201d and with no fear of facing prosecution while they remain in<br \/>\noffice.<\/p>\n<p>The Independent Corrupt Practices and Other Related Offences Commission<br \/>\n(ICPC) already found in a recent report that Nigerian federal lawmakers<br \/>\nuse the Constituency Projects as a conduit for pocketing public funds.<\/p>\n<p>This will deny justice to Nigerian victims of human rights violations<br \/>\nand abuses caused by corruption.<\/p>\n<p>All human rights can be restricted by corruption, be they economic,<br \/>\nsocial, cultural, civil, or political rights. Opening the door to<br \/>\nimpunity threatens the rights of all people in Nigeria. The higher<br \/>\nlevels of corruption, the lesser degree of human rights protection. For<br \/>\nexample, corruption in the management of public resources and public<br \/>\nservices denies people their right to education, health and other<br \/>\nrights.<\/p>\n<p>Criminal prosecution represents the best hope for holding lawmakers to<br \/>\naccount for corruption, since Nigerian laws do not currently allow<br \/>\npeople to pursue cases in civil or human rights action against corrupt<br \/>\npoliticians.<\/p>\n<p>If lawmakers want to protect themselves from politically motivated<br \/>\ncharges, they should pass laws to reform and improve the country\u2019s<br \/>\ncriminal justice system. This will ensure that due process is always<br \/>\nobserved in corruption cases, including those that involve lawmakers,<br \/>\nand that the executive does not use its anti-corruption fight as a tool<br \/>\nfor political expediency.<\/p>\n<p>Whether the Speaker of the House of Representatives Mr Femi Gbajabiamila<br \/>\nwill use his leadership position to ensure that the bill is dropped,<br \/>\nremains to be seen.<\/p>\n<p>President Muhammadu Buhari\u2019s job of tackling corruption is already<br \/>\ncomplicated enough without immunity for lawmakers. He now must publicly<br \/>\ncondemn and reject the bill, if he is to be able to deliver on his<br \/>\nanti-corruption promises to Nigerians.<\/p>\n<p>It\u2019s time for Mr Buhari\u2019s government to comply in law and in<br \/>\npractice with Nigeria\u2019s international obligations and commitments.<\/p>\n<p>But if the bill will go ahead, it\u2019s up to the public to put pressure<br \/>\non the lawmakers to drop the bill and stop the impunity. That means<br \/>\npeople being constantly on their guard against corruption and to ensure<br \/>\nthat the public interest is protected in any constitutional amendment.<\/p>\n<p>Otherwise, Nigeria\u2019s lawmakers will be able to cloak corruption behind<br \/>\nthe shield of immunity.
