\nWhen Nigeria\u2019s President Muhammadu Buhari was named by the African
\nUnion as its first \u201canti-corruption champion in Africa\u201d in 2018, he
\ncalled on member states to \u201cinvest in institutions to entrench
\ntransparency and accountability.\u201d But the recent push by many
\nlawmakers from his All Progressives Congress (APC) party to grant
\nthemselves immunity from prosecution for corruption would seem to leave
\nMr Buhari\u2019s national commitment to tackle corruption in tatters and
\nfatally undermined.<\/p>\n

The bill, known as \u201cBill for an Act to Alter Section 308 of the
\nConstitution of the Federal Republic of Nigeria, 1999 to Extend Immunity
\nto Cover Presiding Officers of Legislative Institutions,\u201d has passed
\nthe second reading at the House of Representatives. It seeks to amend
\nSection 308 of the constitution to extend immunity to all the principal
\nofficers at the country\u2019s National Assembly and the houses of assembly
\nof the states while in office.<\/p>\n

Briefly, Section 308 provides that: \u201cno civil or criminal proceedings
\nshall be instituted or continued against the President, Vice President,
\nGovernors and Deputy Governors during their period of office.\u201d<\/p>\n

The proposed amendment to Section 308 to cover the lawmakers would mean
\nthat any criminal or civil action for crime of corruption or other
\negregious crimes they commit while in office would be stayed until the
\nexpiration of their tenure.<\/p>\n

The bill first appeared in parliament in 2016 but the lawmakers then
\nbacktracked after a public outcry over the move.<\/p>\n

In effect, the bill will protect lawmakers from legal consequences for
\ncorruption, exacerbate the impunity that prevails in Nigeria\u2019s
\npolitical circles and worsen the country\u2019s ranking in Transparency
\nInternational\u2019s Corruption Perception Index. And this would have a
\nnegative effect on the human rights of Nigerians.<\/p>\n

Since the return of democracy in 1999, several politicians\u2014including
\ngovernors with allegations of corruption against them \u2014 have sought to
\nhide out in the National Assembly. The proposed bill will now make them
\nalmost untouchable once they swear their oath of office as lawmakers.<\/p>\n

Some lawmakers, including the sponsor of the bill, Odebunmi Olusegun of
\nOgo-Oluwa\/Surulere federal constituency (APC, Oyo), and at least two
\nmembers of the opposition People’s Democratic Party (PDP)\u2014Toby
\nOkechukwu (PDP, Enugu) and Nkem-Abonta Uzoma (PDP, Abia) \u2014believe that
\nthe bill will protect them from \u201cblackmail\u201d while in office; that
\nfear is misplaced.<\/p>\n

The lawmakers are already covered by parliamentary immunity under the
\nLegislative Houses (Powers and Privileges) Act, 2018, which means they
\nare immune from civil or criminal proceedings for anything they say in
\nparliament.<\/p>\n

This is a privilege developed to ensure open and fearless debate in
\nParliament and is similar to the situation of lawmakers in the US and
\nUK, where members of Parliament cannot be sued for defamation for
\nstatements made in Parliament, which Nigerian politicians frequently
\ncite as \u201cbest practices.\u201d<\/p>\n

However, this Act doesn\u2019t shield lawmakers from prosecution for crime
\nof corruption or other egregious crimes. The proposed amendment to
\nSection 308 would now extend the immunity provided under the Act to
\nshield lawmakers from criminal and civil proceedings, far beyond
\nexisting Parliamentary privileges and immunities.<\/p>\n

The push for immunity for lawmakers ignores the history and legacy of
\ncorruption in Nigeria and its impact on human rights. It\u2019s also at
\nodds with Nigeria\u2019s international commitments as a member of the
\nUnited Nations and the Commonwealth.<\/p>\n

There is no legal justification to provide immunity to lawmakers beyond
\nthe privileges they already enjoy, as to do so would be antithetical to
\nthe fundamental principle that all persons are equal before the law, and
\nto Nigeria\u2019s voluntary obligations under the UN Convention against
\nCorruption, which in article 30(2) requires states parties to limit
\nimmunity from investigation, prosecution or adjudication of corruption
\noffences.<\/p>\n

Similarly, the Commonwealth Working Group on the Recovery and
\nRepatriation of Assets of Illicit Origin has stated that Heads of
\nState\/Government, ministers and other public officials should not have
\nimmunity from prosecution for alleged criminal activity.<\/p>\n

Lawmakers also argue that if the president, his deputy, state governors
\nand their deputies can enjoy immunity, there is no reason why they
\nshould not also enjoy immunity. But it\u2019s difficult to see how granting
\nimmunity to lawmakers will aid the fight against grand corruption in the
\ncountry.<\/p>\n

The lawmakers\u2019 \u201clevelling up\u201d strategy is in fact
\ncounter-productive, as section 308 of the Constitution is already shown
\nto impede disproportionately the conduct of inquiries, prosecutions and
\nthe sentencing of the persons it covers, and thereby contributing to the
\nprevailing impunity of politicians for corruption.<\/p>\n

Lawmakers\u2019 immunity from prosecution for corruption would fuel
\nperceptions that those charged with the responsibility to make laws for
\nthe country are seeking to use their position to stay one step ahead of
\nthe law.<\/p>\n

Rather than trying to \u201clevel up\u201d with the executive\u2014at both the
\nfederal and state levels\u2014members of the House of Representatives
\nshould push to exclude section 308 or limit its application to cases of
\ncorruption and other similar crimes that have an impact on human rights.
\nDoing this will prompt real change in the country\u2019s political culture
\nand help to improve the lawmakers\u2019 image with Nigerians.<\/p>\n

If the bill is passed, it will constrain the ability of Mr Buhari\u2019s
\ngovernment to fight corruption, as it will mean that lawmakers will see
\nexpanded opportunities to line their pockets and divert scant public
\nresources through, for example, the so-called \u201cConstituency
\nProjects\u201d and with no fear of facing prosecution while they remain in
\noffice.<\/p>\n

The Independent Corrupt Practices and Other Related Offences Commission
\n(ICPC) already found in a recent report that Nigerian federal lawmakers
\nuse the Constituency Projects as a conduit for pocketing public funds.<\/p>\n

This will deny justice to Nigerian victims of human rights violations
\nand abuses caused by corruption.<\/p>\n

All human rights can be restricted by corruption, be they economic,
\nsocial, cultural, civil, or political rights. Opening the door to
\nimpunity threatens the rights of all people in Nigeria. The higher
\nlevels of corruption, the lesser degree of human rights protection. For
\nexample, corruption in the management of public resources and public
\nservices denies people their right to education, health and other
\nrights.<\/p>\n

Criminal prosecution represents the best hope for holding lawmakers to
\naccount for corruption, since Nigerian laws do not currently allow
\npeople to pursue cases in civil or human rights action against corrupt
\npoliticians.<\/p>\n

If lawmakers want to protect themselves from politically motivated
\ncharges, they should pass laws to reform and improve the country\u2019s
\ncriminal justice system. This will ensure that due process is always
\nobserved in corruption cases, including those that involve lawmakers,
\nand that the executive does not use its anti-corruption fight as a tool
\nfor political expediency.<\/p>\n

Whether the Speaker of the House of Representatives Mr Femi Gbajabiamila
\nwill use his leadership position to ensure that the bill is dropped,
\nremains to be seen.<\/p>\n

President Muhammadu Buhari\u2019s job of tackling corruption is already
\ncomplicated enough without immunity for lawmakers. He now must publicly
\ncondemn and reject the bill, if he is to be able to deliver on his
\nanti-corruption promises to Nigerians.<\/p>\n

It\u2019s time for Mr Buhari\u2019s government to comply in law and in
\npractice with Nigeria\u2019s international obligations and commitments.<\/p>\n

But if the bill will go ahead, it\u2019s up to the public to put pressure
\non the lawmakers to drop the bill and stop the impunity. That means
\npeople being constantly on their guard against corruption and to ensure
\nthat the public interest is protected in any constitutional amendment.<\/p>\n

Otherwise, Nigeria\u2019s lawmakers will be able to cloak corruption behind
\nthe shield of immunity. That will allow them to do as they please and
\nrestrict access to justice for victims of corruption, with devastating
\nconsequences for human rights and the public interest.<\/p>\n
