Governor Wike declared a lockdown in Rivers State as did other states.
\nYesterday one Calverton helicopter brought in 10 persons into the city
\nPort Harcourt in direct disregard for the health of the people of Rivers
\nState. The Governor ordered for the arrest of the ferried workers and
\nthe two pilots that flew them in. They have been charged to court and
\nare currently held in custody, awaiting trial.<\/p>\n

This morning the Minister of Aviation announced on television that he,
\nthe Minister, authorized the flight. He argued that because Aviation is
\nexclusively under the purview of the federal government, the Governor
\nhas no power to stop them from breaching the lockdown order, talk less
\narrest them. He cited national security interest. Specifically he stated
\nthat due to the fall in oil price the federal government needed to keep
\nthe oil industry revenue flowing.<\/p>\n

I find the Minister of Aviation\u2019s argument nauseating but not
\nsurprising given how reckless the Nigerian government sees Rivers State,
\nthe region that sustains the economy of Nigeria.<\/p>\n

The Minister needs to understand that for obvious reasons, the President
\nof the Federal Republic of Nigeria has less inherent authority to
\nrespond to pandemics than governors. In order words, the Governor of a
\nstate and his people are closer to each other and are at the receiving
\nend of the pandemics.<\/p>\n

The Federal Republic of Nigeria\u2019s constitutional powers arise as
\nenumerated powers\u2014it has only the powers granted it by the
\nConstitution. The Constitution of the Federal Republic of Nigeria 1999,
\nschedule 2, parts I and II enumerate the powers expressly reserved to
\nthe federal government. Although\u201cQuarantine\u201d is one of the
\nEnumerated Powers, see Constitution of the Federal Republic of Nigeria
\n1999, schedule 2, part I, paragraph 54; \u201cQuarantine\u201d has been used
\nonly once in Nigeria\u2019s history, never since independence, and arises
\nfrom the 1926 Quarantine Act to authorize or require port health
\nofficers to take a host of measures to prevent the importation into and
\nspread of infectious diseases within Nigeria.<\/p>\n

\u201cQuarantine\u201d as referenced in the laws of Nigeria and the
\nConstitution of the Federal Republic of Nigeria 1999, schedule 2, part
\nI, paragraph 54 are inapplicable to the current dispute regarding the
\npowers of H.E. Governor Wike to issue orders to protect the health and
\nsafety of the citizens of Rivers State. That power arises from what is
\nknown as the \u201cResidual Powers List\u201d, which though not expressly
\nprovided for in the Constitution, captures the residue, that is, all
\nthat is not specified in the Exclusive and Concurrent Lists. The
\nNigerian state governments have absolute authority to legislate on those
\nissue. See _AG Abia State v AG Federation_ (2006) 16 NWLR (Part 1005)
\n265 at 380-381, paras. D-C, per Ngwuta JSC.<\/p>\n

Significantly, the Nigerian Supreme Court held that unlike State orders
\nor laws involving matters of concurrent or exclusive jurisdiction where
\nthe State legislative or executive action cannot run counter to the
\nfederal action,\u00a0 the doctrine of covering the field does not apply to
\nstate action in residual matters. _AGF v. AG Lagos_, Suit No. SC
\n340\/2010 [2013], 16 NWLR (Part 1380) 249.<\/p>\n

The states, by contrast, possess a general police power\u2014an _inherent_
\nauthority that is then limited by both the state and federal
\nConstitution. A governor or state legislature can often act without a
\nspecific grant of power. The power to act is presumed, absent a specific
\nlimitation. That is the essence of a federal system.<\/p>\n

The United States has a more well-defined and historically robust
\nfederal system than does Nigeria. However, Nigeria is still a federal
\nRepublic and the centralization of power is not unchecked. Just as it
\nwould horrify many in Aso Rock if it were determined that religious
\nobservations and customs -including Sharia Law, for instance were banned
\nbecause the federal government has exclusive constitutional authority in
\nthat sphere, so should the federal government stand down in this
\nCalverton Helicopter Incident. In 1824, the U.S. Supreme Court observed
\nin _Gibbons v. Ogden_ that sovereign state authority includes the
\nauthority to enact \u201cquarantine laws\u201d and \u201chealth laws of every
\ndescription.\u201d<\/p>\n

It may be useful to address the question thusly: just as Nigeria\u2019s
\npresident and the federal government in general are acting at the peak
\nof their powers during times of war when national security is
\nthreatened, Nigeria\u2019s governors are often at the peak of _their_ power
\nwhen public health is at stake.<\/p>\n

Rivers State is \u201cat War\u201d with COVID-19. H.E. Chief Nyesom Wike is
\nentrusted with the health and well-being of the citizens of Rivers State
\nand he has the power to impose a lockdown and arrest or thwart anyone
\nthat threatens Rivers State during this health crisis \u2013 even if that
\nthreat is employed by or excused by the federal government.\u00a0 The
\nCOVID-19 virus does not know the difference, and neither must Chief Wike
\nif he is to win this War against COVID-19 and the real threat of a
\npandemic that could kill hundreds of thousands of Rivers\u2019 people.<\/p>\n

Clearly, Governor Wike\u2019s lockdown is not a regulation of aviation or
\nthe oil industry but an evenhandedly applied health and safety response
\nto the pandemic, just as the lockdown\u2019s prevention of political
\nrallies or attendance at football matches are not regulations of free
\nspeech and association or sport.\u00a0 The incidental effects of a lockdown
\ncannot invalidate its compelling and urgent legitimate objective.
\nOtherwise, government would be helpless in fighting pandemics that
\nthreaten all.\u00a0 No constitution should be interpreted to make it a
\nsuicide pact.<\/p>\n

The federal government and the Ministry of Aviation cannot want to
\nimprove oil revenue at the expense of the health and well-being of the
\ncitizens of Rivers State. The Minister has taken the joke too far. He
\nwants to kill Rivers people simply because he needs oil revenue. The
\nMinister should listen to himself again.<\/p>\n
