\n(CHRSJ) has written a Petition Letter to the nations\u2019 anti-graft bodies
\nover an alleged collection of sum of Seven Hundred Million Naira (N700,
\n000,000) from meager resources of Osun State illegally by the purported
\noccupier \u201cAkesin-Ora\u201d, one Mr. Samuel Idowu Oladoye, after September
\n1st,
\n1995 Supreme Court judgment which declared the title stool of Akesin-Ora
\nas
\nnull, void, illegal and unknown to the existing Ora-Igbomina Chieftaincy
\nLaws.<\/p>\n
Specifically, The Supreme Court gave an order by declaring on the
\nOra-Igbomina Chieftaincy matter that Akesin should not be recognized as
\nOba
\nand not to talk of wearing beaded crown under the Chiefs Law of Osun
\nState
\nin September 1st, 1995 and it also awarded cost of N1, 000 against
\n“Akesin
\nOra” then, for wasting the precious time of the Courts on frivolous
\napplication.<\/p>\n
It would be recalled that Ora-Igbomina Obaship saga vis a vis
\ndisobedience
\nto the Supreme Court Judgments, has been in the news for a while now
\nwhere
\nthe Apex Court also declared in its ruling that Akesin was one of the
\nChiefs of Oba Asaaoni and it could not change himself into wearing
\nbeaded
\ncrown monarch overnight.<\/p>\n
Meanwhile, a monarch in Osun State, the Owaloja of Kajola-Ajaba in Ila
\nLocal government area of the State, His Royal Majesty,Oba (Dr.) Taiwo
\nAdesoji Ayeni,has challenged the State government, Ila Local
\nGovernment and Ila Traditional Council which
\ncomprises of monarchs from Ila and Ifedayo local government areas of
\nthe State,over continuous illegal payment of five percent allocation
\nto \u201cAkesin-Ora\u201d after the Supreme Court had nullified the Chieftaincy
\ntitle since September 1, 1995.<\/p>\n
Oba (Dr.) Ayeni who claimed this through an application with a suit
\nNo: HLR\/2\/19,
\nfilled in Ila \u2013Orangun Division of the State High court\u00a0 that the
\nillegal
\nallocation to \u201cAkesi-Ora\u201d has drastically reduced the original amount to
\nbe
\nallocated to the authentic monarchs in the area.<\/p>\n
According to CHRSJ in a Petition Letter dated February 3rd, 2020 and
\nsigned
\nby its Executive Chairman, Comrade Adeniyi, Alimi Sulaiman, which was
\nforwarded to the
\nauthorities of\u00a0 Economic and Financial Crimes Commission(EFCC) and
\nIndependent Corrupt Practices and Other Related Offences Commission
\n(ICPC),calling for thorough and credible investigation of alleged
\nillegal
\ncollection of sum of\u00a0 N700,000,000 by the purported claimant of
\n\u201cAkesin-Ora\u201d, Mr. Samuel Idowu Oladoye since\u00a0 September 1st,1995.<\/p>\n
The group accused the occupier of illegal stool of Akesin-Ora, Mr.
\nSamuel
\nIdowu Oladoye of obtaining sum through fraudulent means and urging the
\nanti-graft agencies to retrieve the illegal funds back to the pursue of
\nthe
\nState government for immediate sharing among the authentic monarchs of
\nthe
\ntwo local government areas of the State.<\/p>\n
The Petition read in part, \u201cWe are compelled to write this Petition
\nLetter
\nto the authorities of the anti-graft agencies in line with Section 15
\nsub-section 5 and 24(1e) of the Constitution and Freedom of Information
\nAct
\n2011 and National Human rights Commission Act 2010(amendment) where
\nfreedom
\nof speech and expression are highlighted.<\/p>\n
\u201cShortly before the handing over of power to the civilian government in
\n1979 in Oyo State (now- Osun State), the then Military Governor, Col.
\nPaul
\nTarfa discretionally granted wearing of beaded crown to Isaiah
\nOlanipekun
\nas Akesin-Ora, making him another Oba when in actual fact, a full-time
\nfledged and crowned Oba, Asaooni of Ora-Igbomina\u00a0 was in place. The
\nsituation then led to riot and unrest in the ancient town.<\/p>\n
“On the arrival of Late Chief Bola Ige’s Government, a Judicial
\nCommission
\nof Inquiry headed by Late Justice V.O.A. Aboderin was set up to
\ninvestigate
\ninto the matter. The report of the inquiry was made known to the public
\nby
\ndeclaring the wearing of beaded crown by the Akesin of Ora as illegal
\nand
\nnegated the old traditional norms.<\/p>\n
“Akesin-Ora challenged the then Oyo (now Osun) State Government in the
\nHigh
\nCourt. The matter went to Ibadan Court of Appeal and ultimately ended in
\nthe Supreme Court. The Supreme Court delivered its judgment in favour of
\nAsaooni on the 1st day of September, 1995, thereby upholding the Report
\nof
\nAboderin Judicial Commission of Inquiry which declared Asaoni as the
\nonly
\nrecognized and beaded crown Oba of Ora-Igbomina kingdom”.<\/p>\n
The Petition further read:”The Constitution is Supreme, not only when
\nanother law seeks to compete with it in an area already covered by the
\nConstitution.The Governor of Osun State or any Government at all is not
\ngiven power to do a thing or act that is inconsistent with and violently
\nin
\ncontradiction to the express words of the Constitution.<\/p>\n
\u201cThe law is settled that the parties as well as the Court are bound by
\nthe
\nProvision of the Constitution. The law is that when an act is void, it
\nis
\nvoid altogether and nothing can be placed on it. Thus, the continuous
\nstay
\nof the deposed “Akesin of Ora-Igbomina as he then was, is not only an
\naffront against the Supremacy of the Supreme Court itself for almost 25
\nyears now but also against the Section 235 & 287 of the 1999
\nConstitution of the
\nFederal Republic of Nigeria (as amended).<\/p>\n
