Arik Air, one of the top players in the nation’s aviation industry, has<\/div>\n
\n
been dragged to court by businessman and publicicist, Simon Imobo-
\nTswam, over breach of contract: the airline refused to convey the
\nbusinessman to Port Harcourt some time in 2018.<\/p>\n

The suit was filed, FH\/ABJ\/CS\/345\/2019, before the Federal High Court,
\nbecame inevitable after all attempts by the businessman to get a fair
\nhearing proved abortve.<\/p>\n

According to the details of the suit, the plaintiff bought a
\nLagos-Return ticket online on 20th September, 2018, for N34,500. 00
\nonly. The date for the trip was 22nd October, 2018, with the return date
\nthree days later.<\/p>\n

But on, the court learnt that on 18th October, 2018, the plaintiff had
\nthe ticket opened since he could no longer\u00a0 travel due to other
\nengagements.<\/p>\n

And then on 29th October, 2018, the plaintiff went to the Defendants
\noffice at Trascorp, A buja, and rerouted the trip to Port Harcourt (i.e.
\nAbuja-Port Harcourt-Abuja). The date for this re-routed trip was 1st
\nNovember and return was on 5th November, 2018.<\/p>\n

The Plaintiff was accordingly surcharged an additional N20, 216.00 only
\nwhich he paid.<\/p>\n

Trouble started for the Plaintiff when he was told on 1st November,
\n2018, that he could not be conveyed to Port Harcourt on the false claim
\nthat the Plaintiff’s name did not tally with the code on his ticket.<\/p>\n

All explanations that the ticket was issued by Arik Air (with all the
\ninformation on it), and that the Port Harcourt trip was very important
\nto the passenger, fell on deaf ears. All pleadings that he bought the
\nticket in his name; and that it is the same name he has given Arik staff
\nin the over 20 times that he has flown on Arik Air did not sway Arik.<\/p>\n

The aggrieved passenger thereafter wrote to the airline through his
\nlawyers, Chris Aashi, Esq., of Fairfield Chambers, on 26th November,
\n2018, and the Defendants replied on 3rd December, 2018.<\/p>\n

In their response, Arik Air, now the Defendants, refused to take
\nresponsibility or make a refund -the arline rather claimed that the
\nPlaintiff bought his ticket in another name.<\/p>\n

It was following this that the Plaintiff sued the airline for “wronful
\nand complete breach of contract; a refund of the N54, 716.00, being the
\ntotal sum paid to the Defendants; and a claim of N100illion only for
\ngeneral damages.<\/p>\n

The matter comes up on 2nd June, 2020, before Justice Evelyn Maha, for
\nmention.<\/p>\n

It would be recalled that only last week, an FCT High Court, presided
\nover by Justice Danlamin Senchi, gave judgement against the airline,
\nordering it to pay an aggrieved passenger, Mr. Modibbo, N10million for
\n“serious breach of contract.”<\/p><\/div>\n<\/div>\n
