The Abuja Division of the Court of Appeal on Friday upheld the election of Gov. Douye Diri of Bayelsa State.<\/div>\n

\nIn doing so, the appellate court overturned the ruling of the Election Petition Tribunal which had earlier nullified the election and ordered for fresh election to be conducted within 90 days.<\/p>\n

A five-man panel of the Appellate Court held that the Tribunal acted outside its jurisdiction by nullifying the election of the governor.<\/p>\n

In a unanimous judgment, the five-man panel of the court said the Advanced Nigeria Democratic Party failed woefully to show that it had a valid candidate that was unlawfully excluded by the Independent National Electoral Commission (INEC).<\/p>\n

The court berated the tribunal for ignoring the fact that the petition of ANDP was status barred in addition to the fact that the party presented an unqualified candidate to INEC in the November 16, 2019 Governorship election in Bayelsa State.<\/p><\/div>\n<\/div>\n
