Socio-Economic Rights and Accountability Project (SERAP) has urged<\/div>\n
\n
President Muhammadu Buhari and Vice-President Professor Yemi Osinbajo to
\n“follow a good example of Mr Yombe Dabai Samaila, deputy governor Kebbi
\nstate, by immediately publishing their asset declaration forms.”<\/p>\n

Mr. Samaila while responding to SERAP’s suit had last week forwarded his
\nasset declaration form to the organization. The form dated 28 May 2019,
\nand sworn to before the High Court of Justice, Bikebbi, Kebbi state,
\nshows that Mr. Samaila declared assets, including landed property and
\ncash in banks, valued at N353,136,378.56, from which he stated that he
\nreceives N61,500,000.00 yearly as income.<\/p>\n

SERAP had in suit number FHC\/ABJ\/CS\/65\/2020 filed in January 2020 asked
\nthe Federal High Court, Abuja to order President Buhari, Vice-President
\nOsinbajo, 36 state governors, and their deputies to “make public details
\nof their assets, specifically property and income, contained in their
\nasset declaration forms submitted to the Code of Conduct Bureau (CCB)
\nsince assuming office.”<\/p>\n

In a statement dated 4 October 2020 and signed by SERAP deputy director
\nKolawole Oluwadare, the organization said: “We welcome Mr. Samaila’s
\ndemonstrated commitment to transparency and accountability, especially
\nat a time when many government officials and institutions continue to
\nexhibit a blatant disregard for Freedom of Information requests by
\nrefusing to even acknowledge several of such requests.”<\/p>\n

SERAP said: “President Buhari and Vice-President Osinbajo should show
\nleadership by immediately widely publishing their asset declaration
\nforms, just as Mr. Samaila has rightly done. We also call on Mr Abubakar
\nBagudu, governor Kebbi state and other governors and their deputies to
\nemulate and learn from Mr. Samaila’s good example by immediately
\npublishing their assets.”<\/p>\n

SERAP also said: “President Buhari and Vice-President Osinbajo should
\nstand up for transparency in asset declarations by public officers as a
\nsign of their oft-repeated principled stand on transparency and
\naccountability in the management of the country’s resources. This
\ngovernment’s stated commitment to fight corruption will ring hollow as
\nlong as Buhari and Osinbajo continue to ignore repeated requests to
\npublish their asset declaration forms.”<\/p>\n

Mr. Samaila’s letter dated 4 September 2020, and signed on his behalf by
\nNura Abdullahi Koko, Director of Administration, read in part: “In
\nreference to your Freedom of Information request and suit, I am directed
\nby Mr. Samaila Yombe Dabai, Deputy Governor Kebbi state to forward
\nherewith a copy of his assets declaration as requested by SERAP.”<\/p>\n

“While thanking you for your understanding, please accept the assurance
\nof the Deputy Governor best regards always.”<\/p>\n

Mr. Samaila’s assets declaration form, read in part: “Cash in Nigerian
\nbanks: N364,420, in a bank in Lagos, which is money from my military
\npension. N1,471, 958.56 in another bank in Kaduna, which is money from
\nmy personal income. I have no cash in foreign banks.”<\/p>\n

“I bought a 3-bedroom flat [upstairs] in Kebbi state through my military
\nsavings and business income in 1984, and the property is valued at N16m.
\nI also have a 6-bedroom and 2 Guest House of 3-bedroom in Kebbi state,
\nvalued at N38m. I have a 4-bedroom duplex in Asokoro, Abuja, which I
\nbought in 2017 through personal income. I have no vacant\/undeveloped
\nplots.”<\/p>\n

“I have a 2-bedroom flat in Kaduna state, and the property is valued at
\nN30m. I bought it in 2001 through savings from business income. I earn
\nN1m yearly from the property. I also have 48 hectares of farmland in
\nKaduna state, as a gift from the Emir of Dande in 1983. The property is
\nvalued at N10m. I make N2.5m yearly from the property.”<\/p>\n

“I have a company named Yomed Nigeria Limited, Kaduna, which deals in
\nair services, primary school, and agriculture service equipment. The
\ncompany was established in 2007 and is valued at N98m. I make N28m
\nmonthly as income from the company.”<\/p>\n

“I also bought CESSNA 206 Aircraft, Kaduna in 2014, and it is valued at
\nN99.6m, and I make N30m yearly as income from this.”<\/p>\n

“I bought a Ford Bus Caravan in 2017, valued at N1.5m; Toyota Tundra in
\n2012 valued at N3m; Range Rover Jeep in 2013 valued at N7m; and another
\nFord Bus Caravan in 2016 valued at N5.2m.”<\/p>\n

“I have 2 sets of furniture and electronics in Kaduna and Zuru, which I
\nbought between 2013\u20142019, and the property is valued at N3m. My wife
\nowns a property valued at N25m but my children own no property. I have
\nno government securities, no shares in and outside Nigeria.”<\/p>\n

It would be recalled that SERAP had in its suit asked the court to grant
\n“an order for leave to apply for judicial review and an order of
\nmandamus to direct and\/or compel President Buhari, Vice-President
\nOsinbajo, 36 state governors and their deputies to make public their
\nsummary of assets; disclose whether they have had any reason to review
\nand update their asset declarations submitted to the CCB and if the
\ndeclarations have been made as constitutionally and statutorily
\nrequired.”<\/p>\n

In the suit, SERAP is seeking “an order to compel President Buhari,
\nVice-President Osinbajo, 36 state governors and their deputies to
\ndisclose whether they have received any confirmation of the verification
\nof their asset declarations by the CCB and to disclose whether they have
\ntaken any steps to encourage members of their cabinet to also submit
\ntheir asset declarations to the CCB, and to make such declarations
\npublic.”<\/p>\n

SERAP is also seeking: “a declaration that the failure of President
\nBuhari, Vice-President Osinbajo, 36 state governors and their deputies
\nto provide SERAP with the requested information on their assets
\nconstitutes a breach of SERAP’s right under the FoI Act, 2011, and such
\nfurther order(s) the Honourable Court may deem fit to make in the
\ncircumstances.”<\/p>\n

The suit followed SERAP’s Freedom of Information (FoI) requests dated 3
\nJanuary 2020, expressing concern that: “The non-public disclosure by
\npublic officials of their summary of assets undermines the effectiveness
\nand integrity of the constitutional and statutory obligations to submit
\nasset declarations.”<\/p>\n

The FoI requests, read in part: “By a combined reading of the
\nConstitution of Nigeria 1999 (as amended), the FoI Act, and the African
\nCharter on Human and Peoples’ Rights, President Buhari, Vice-President
\nOsinbajo, 36 state governors and their deputies ought to be directed and
\ncompelled to make public their asset declarations as submitted to the
\nCCB.”<\/p>\n

According to SERAP, two states \u2014 Lagos State and Niger State \u2014 have
\nresponded to its FoI requests. But both states declined the requests to
\nmake public the assets of their governors and deputies, on the ground
\nthat “the FoI Act is inapplicable to state governments, their agencies
\nand officials, and that only houses of assembly of states are
\nconstitutionally empowered to make laws on public records of states.”<\/p>\n

Also, while reacting to SERAP FoI request to President Buhari, Femi
\nAdesina, Special Adviser to the President on Media and Publicity, had
\nsaid: “SERAP asking the president to declare publicly, on the basis of
\nwhat law? The president will do what the law requires of him and what
\nthe law requires is that he should declare his asset which he has done.
\nDeclaring publicly is not in our laws; it can only be a voluntary
\nthing.”<\/p>\n<\/div>\n<\/div>\n
