Socio-Economic Rights and Accountability Project (SERAP) has sent a<\/div>\n
\n
\n

petition to Mrs. Fatou Bensouda, Prosecutor, International Criminal
\nCourt (ICC), urging her to “promptly investigate reports that Nigerian
\nauthorities, military, and some politicians have used\/ and are using
\nthugs, soldiers and security agents to intimidate, harass, attack and
\nkill #EndSARS peaceful protesters in several parts of Nigeria, including
\nAbuja, Lagos, Edo, Osun, Plateau, and Kano states.”<\/p>\n

SERAP urged Mrs. Bensouda to “push for those suspected to be responsible
\nfor these crimes, mostly security officials, soldiers, some politicians
\nand other actors who directly or indirectly have individually and\/or
\ncollectively contributed to the attacks, deaths, and injuries, and are
\ntherefore complicit in the crimes, to be tried by the ICC.”<\/p>\n

In the petition dated 21 October 2020 and signed by SERAP deputy
\ndirector Kolawole Oluwadare, the organization said: “The Nigerian
\nauthorities over the years have been unwilling and\/or unable to
\nprosecute suspected perpetrators of the killing of protesters, which in
\nturn has promoted a culture of impunity and emboldened authorities, the
\nmilitary, politicians and their accomplices who continue to commit human
\nrights crimes against protesters.”<\/p>\n

SERAP said: “The violent attacks on peaceful protesters in Lekki,
\nAlausa, and other parts of the country suggest the lack of political
\nwill by the government of President Muhammadu Buhari to respect people’s
\nhuman rights, including the rights to life, the dignity of the human
\nperson, freedom of expression, peaceful assembly, and association.”<\/p>\n

According to SERAP: “The repeated attacks on peaceful protesters suggest
\nthe misuse of the military and security agents by the Nigerian
\nauthorities and the failure to apply criminal sanctions to suspected
\nperpetrators.”<\/p>\n

The petition, read in part: “Without accountability for these serious
\nhuman rights crimes against peaceful protesters, the victims will
\ncontinue to be denied access to justice, and impunity of perpetrators
\nwill remain widespread and the result will continue to be a vicious
\ncycle of violence against Nigerians.”<\/p>\n

“Nigerian authorities, military, and some politicians have failed
\nabysmally to ensure the enjoyment of the rights to life, dignity,
\nfreedom of expression, and peaceful protest by the people. These events
\nsuggest criminal conduct within the jurisdiction of the ICC.”<\/p>\n

“SERAP believes that violence against protesters gives rise to the
\nindividual criminal responsibility of those suspected of perpetrating
\nand\/or failing to address the problem. as entrenched in the Rome
\nStatute.”<\/p>\n

“The incidents of intimidation, harassment attacks, and killings of
\npeaceful protesters also strike at the integrity of the democratic
\nprocess and seriously undermine President Muhammadu Buhari’s
\noft-expressed commitment to human rights and the rule of law, and to end
\nimpunity of perpetrators.”<\/p>\n

“Persistent attacks on peaceful protesters by Nigerian authorities,
\nmilitary, security agents and some politicians seriously undermine the
\npeople’s right to participate in their own government, and have resulted
\nin serious human rights crimes within the jurisdiction of the ICC.”<\/p>\n

“Ending impunity for attacks on peaceful protesters would improve
\nrespect for human rights in the country, and empower the citizens to
\nhold their leaders to account. Unless the citizens are freely allowed to
\nexercise their right to protest, the pervasive culture of impunity will
\ncontinue to flourish in the country.”<\/p>\n

“The government of President Muhammadu Buhari has repeatedly failed to
\naddress these grave human rights violations, which amount to crimes
\nagainst humanity within the jurisdiction of the ICC.”<\/p>\n

“The use of thugs and soldiers against peaceful protesters has resulted
\nin several deaths and injuries. Nigerian authorities have failed and\/or
\nneglected to prevent these crimes against peaceful protesters.”<\/p>\n

“Nigeria is a state party to the Rome Statute and deposited its
\ninstrument of ratification on 27 September 2001. It is therefore
\nimportant to promptly investigate allegations of killings and other
\nattacks on peaceful protesters if the ICC is to contribute to preventing
\nescalations in the coming days, months, and years.”<\/p>\n

“The CCTV monitoring cameras at the Lekki toll gate and street lights
\nwere reportedly turned off before soldiers opened fire on peaceful
\nprotesters. This suggests a deliberate ploy by the authorities to cover
\nup these crimes against humanity.”<\/p>\n

“Nigerian authorities, military, and politicians have failed to
\nunderstand the seriousness of killings of peaceful protesters, and have
\nbeen complicit in the commission of these crimes.”<\/p>\n

“According to our information, Nigerian authorities, military, and some
\npoliticians have used thugs, the police and soldiers to intimidate,
\nharass, attack and shoot at peaceful protesters campaigning against
\npolice brutality across several parts of the country including Abuja,
\nLagos, Edo, Oyo, Osun, Plateau, and Kano states.”<\/p>\n

“The protests began on October 8, 2020, calling on the authorities to
\nabolish an abusive police unit called the Special Anti-Robbery Squad
\n(SARS). Just last night, several people taking part in the #EndSARS
\npeaceful protests at the Lekki Toll Gate, and Alausa in Lagos were
\nreportedly shot dead or wounded by soldiers. Several journalists
\ncovering the protests have been severely attacked.”<\/p>\n

“Nigerian authorities have shot tear gas, water cannons, and live rounds
\nat protesters, reportedly killing at least 60 people and wounding
\nseveral others. According to Amnesty International, on October 10, Jimoh
\nIsiaka was allegedly killed when police opened fire to disperse
\nprotesters in Ogbomosho, Oyo state.”<\/p>\n

“At least two other people were killed the following day in protests
\nagainst Isiaka’s death. On October 12, police officers in Surulere,
\nLagos, reportedly opened gunfire to disperse protesters, killing
\n55-year-old Ikechukwu Ilohamauzo.”<\/p>\n

“On October 15, the Nigerian army warned ‘subversive elements and
\ntroublemakers’ to desist and offered to ‘support the civil authority in
\nwhatever capacity to maintain law and order.’ The Nigerian military has
\nalso been complicit in human rights abuses, including the use of lethal
\nforce against peaceful protesters.”<\/p>\n

“Nigeria has a long history of systematic and widespread attacks on
\npeaceful protesters especially since President Muhammadu Buhari assumed
\npower in May 2015. Nigerian authorities have failed to ensure justice
\nfor the killings of protesters. Hundreds of members of the Shia Islamic
\nMovement of Nigeria (IMN) were killed by the Nigerian Army in Zaria,
\nKaduna State on December 12, 2015.”<\/p>\n

“The Rome Statute in article 7 defines “crime against humanity” to
\ninclude “inhumane acts causing great suffering or injury,” committed in
\na widespread or systematic manner against a civilian population. The
\ncommon denominator of crimes against humanity is that they are grave
\naffronts to human security and dignity.”<\/p>\n

“The consequences of persistent violence, attacks, and killings of
\npeaceful protesters in Nigeria are similar to those of the offences in
\narticle 7(1). Senior government officials, the military, and some
\npoliticians know well or ought to know that their failure to prevent
\nthese crimes will violate Nigerians’ human rights and dignity.”<\/p>\n

“SERAP considers the apparent failure of the government of President
\nMuhammadu Buhari to prevent widespread and systematic attacks on
\npeaceful protesters and the killing of protesters as amounting to
\ncomplicity under the Rome Statute. SERAP, therefore, believes that the
\nwidespread and systemic nature of the problem fits the legal
\nrequirements of violence against the Nigerian people and crime against
\nhumanity.”<\/p>\n

“The national authorities of the Court’s States Parties form the first
\nline of defense in addressing the crime against humanity during
\nprotests, as they shoulder the primary responsibility for the
\ninvestigation and prosecution of perpetrators of the crime. But Nigerian
\nauthorities have been unwilling or unable to address the problem of
\nattacks on peaceful protesters, and end the crimes against humanity.”<\/p>\n

“SERAP urges you to investigate the killing of protesters, and other
\nattacks perpetrated against protesters, and if there is sufficient
\nadmissible evidence prosecute officials, soldiers and any politicians
\nfor allegations of killing and violence against protesters, as provided
\nfor under the Rome Statute, and other relevant treaties, to deter the
\ncrimes and end impunity in the country.”<\/p>\n

“SERAP believes that substantial grounds exist to warrant the
\nintervention of the Prosecutor in this case. Under Article 17 of the
\nRome Statute, the Court is a court of last resort, expected to exercise
\nits jurisdiction only if states themselves are unwilling or unable
\ngenuinely to investigate and prosecute international crimes.”<\/p>\n

“Also, pursuant to the Rome Statute, the Prosecutor has the power to
\nintervene in a situation under the jurisdiction of the Court if the
\nSecurity Council or state parties refer a situation or if the
\ninformation is provided from other sources such as the information SERAP
\nis providing in this case.”<\/p>\n

SERAP, therefore, urged the ICC to:<\/p>\n

1.\u00a0\u00a0\u00a0\u00a0 Urgently commence an investigation proprio motu on the widespread
\nand systematic problem of attacks on protesters, with a view to
\ndetermining whether these amount to violence against the Nigerian people
\nand crime against humanity within the Court’s jurisdiction. In this
\nrespect, we also urge you to invite representatives of the Nigerian
\ngovernment, the military to provide written or oral testimony at the
\nseat of the Court, so that the Prosecutor is able to conclude since
\navailable information whether there is a reasonable basis for an
\ninvestigation, and to submit a request to the Pre-Trial Chamber for
\nauthorization of an investigation;
\n2.\u00a0\u00a0\u00a0\u00a0 Bring to justice those suspected to be responsible for widespread
\nand systematic attacks on peaceful protesters across the country;
\n3.\u00a0\u00a0\u00a0\u00a0 Urge the Nigerian government to fulfill its obligations under the
\nRome Statute to cooperate with the ICC; including complying with your
\nrequests to arrest and surrender suspected perpetrators of the
\nwidespread and systematic crime of violence against peaceful protesters,
\ntestimony, and provide other support to the ICC;
\n4.\u00a0\u00a0\u00a0\u00a0 Compel the Nigerian authorities to ensure that Nigerians are
\nafforded their right to life, dignity, freedom of expression, peaceful
\nassembly, and association, and ensure reparations to victims, including
\nrestitution, compensation, rehabilitation, and a guarantee of
\nnon-repetition<\/p>\n<\/div>\n<\/div>\n
