Division of the Court of Appeal as of December 1, 2020.<\/p>\n

The President of the Court of Appeal, Justice Monica Dongban-Mensem,
\ngave the figures on Monday at the opening of the court\u2019s first Working
\nRetreat and Annual Conference of Justices of the Court of Appeal.<\/p>\n

The event held at the premises of the Court of Appeal, Lagos Division.<\/p>\n

Dongban-Mensem said that 345 appeals comprising 289 commercial appeals,
\n10 human rights appeals and 46 criminal appeals were scheduled for
\nhearing during the four-day retreat.<\/p>\n

The retreat had the theme: \u201cCourt of Appeal: Challenges and the Way
\nForward\u201d.<\/p>\n

According to Dongban-Mensem, the 345 appeals scheduled for hearing
\nrepresent only eight percent of the total number of appeals in the
\ndivision.<\/p>\n

She said that it might appear to be a difficult task, \u201cbut we are
\ndetermined to decongest the court\u201d.<\/p>\n

Dongban-Mensem said that the working retreat would consist of special
\ncourt sessions involving 23 Special Appellate Panels.<\/p>\n

She added that due to time and space constraints, the panels would sit
\nin batches of six special panels on each designated days from Dec. 7 to
\nDec. 10, from 9.00a.m. to 12.00p.m. daily.<\/p>\n

The Court of Appeal president said that each panel would hear about 15
\nappeals, with five panels sitting at five designated courtrooms of the
\nNational Industrial Court in\u00a0 Ikoyi, Lagos, and one panel at Court 1 of
\nthe Court of Appeal, Lagos Division.<\/p>\n

She said that the management of the court hoped that the exercise would
\ncontinue in the various appeal court divisions until the reduction of
\nthe backlog.<\/p>\n

\u201cUndoubtedly, the Court of Appeal, Lagos Division, is a critical
\ndivision within the court; it sits at the commercial nerve centre of our
\ngreat nation, Nigeria.<\/p>\n

\u201cDespite this, the division has continued to experience a delay in the
\nhearing of appeals before it, largely due to the volume of appeals in
\nits docket and the limited number of justices available to hear them,\u201d
\nDongban-Mensem said.<\/p>\n

She said that the retreat was expected to feature special court sittings
\nby all justices of the Court of Appeal from all the divisions of the
\ncourt.<\/p>\n

Dongban-Mensem said that on the assumption of office, she discovered
\nthat many appeals had either been abandoned or purposely left to linger
\nendlessly by mischievous and flippant actors in the litigation process.<\/p>\n

She said that it was regrettable to note that some of the appeals were
\nfiled with the aim of stalling the judicial process.<\/p>\n

\u201cThis situation must not be allowed to continue. We have come out to
\ndemonstrate our abhorrence by taking the bull by the horn,\u201d she said.<\/p>\n

Dongban-Mensem said that the purpose of the retreat was to send out a
\nwarning to the public that the court would no longer be a dumping ground
\nfor those seeking to hamper justice delivery.<\/p>\n

She noted that justices in the court were\u00a0 70 in number at present \u2013\u00a0 20
\nless in the statutorily required 90 justices for the Court of Appeal.<\/p>\n

\u201cOur actions this week will afford us all a chance to discuss various
\naspects of our work, health, and wellbeing.<\/p>\n

\u201cIt is my desire and expectation that under my stewardship, delay in
\nhearing appeals will become a thing of the past, not just in Lagos
\ndivision but also in other divisions of the Court of Appeal,\u201d she said.<\/p>\n

The appellate court president, however, expressed appreciation to the
\nvarious heads of courts.<\/p>\n

Prof. Taiwo Osipitan (SAN) represented the Body of Senior Advocates of
\nNigeria at the event.<\/p>\n

Osipitan called for a review for the qualifications to become a senior
\nadvocate of Nigeria.<\/p>\n

He said that many frivolous applications at the Court of Appeal were
\nbeing filed by lawyers to meet a prerequisite for becoming a member of
