Balogun of a Lagos State High Court, Ikeja admitting<br \/>\nin evidence more documents against him.The Economic and Financial Crimes Commission, EFCC is prosecuting<br \/>\nPeters, alongside his company, Nababo Energy Limited, for allegedly<br \/>\nobtaining N1, 464,961,978.24 from the Federal Government as oil subsidy<br \/>\nusing forged documents.<\/p>\n<p>They pleaded &#8220;not guilty&#8221; to the charge preferred against them.<\/p>\n<p>At today&#8217;s sitting, Justice Balogun admitted in evidence, two letters<br \/>\nfrom Q &amp; Q Services Nigeria Limited written to the EFCC in response to<br \/>\ntwo investigation letters earlier sent to the company by the anti-graft<br \/>\nagency with regards to the transactions.<\/p>\n<p>The two letters dated 20th March 2013 and 28th March 2013 were tendered<br \/>\nin evidence by S.K. Atteh, the prosecuting counsel through the fifth<br \/>\nprosecution witness, Abdulrasheed Bawa.<\/p>\n<p>Identifying the documents, Bawa, an EFCC operative told the Court that<br \/>\nthe two letters from Q &amp; Q Services Nigeria Limited were in response to<br \/>\nthe request of the EFCC to furnish it with the documents relating to<br \/>\ntransaction involving Nadabo Energy Limited.<\/p>\n<p>According to Bawa, after studying the documents submitted to the<br \/>\nPetroleum Products Pricing Regulatory Agency, PPPRA, indicating that the<br \/>\ndefendant imported about 14,000 metric tonnes of PMS, the EFCC wrote an<br \/>\ninvestigation activities letters to Q &amp; Q Control Services Limited<br \/>\nrequesting for the authentication of the documents.<\/p>\n<p>&#8220;Q &amp; Q Control Services Limited responded via their letters dated 20th<br \/>\nMarch 2013 and 28th March 2013 and attached several documents that were<br \/>\nrequested,&#8221; he said.<\/p>\n<p>Atteh tendered the original copies of the letters.<\/p>\n<p>No objection was raised from the defence counsel, Habeeb Oredola, who<br \/>\nheld the brief of J.B. Daudu.<\/p>\n<p>Justice Balogun, thereafter admitted them in evidence as Exhibit L1 and<br \/>\nL2.<\/p>\n<p>The trial judge, also admitted in evidence as Exhibit K1 and K2, the<br \/>\ncopies of the two investigation letters written by the EFCC to the Q &amp; Q<br \/>\nControl Services Limited to which the company responded to through<br \/>\nExhibit L1 and L2.<\/p>\n<p>Testifying, further, Bawa noted that Q &amp; Q was contacted to confirm the<br \/>\ngenuineness or otherwise of the documents submitted by the defendant to<br \/>\nPPPRA for the transaction.<\/p>\n<p>He explained that from the analysis of the response, &#8220;we found out that<br \/>\ncontrary to the claim of the defendant as par Exhibit B, which they<br \/>\nsubmitted to PPPRA to claim subsidy, the defendant imported only 4,850<br \/>\nmetric tonnes of PMS as opposed to 14,000 metric tonnes that he claimed<br \/>\nto have imported.&#8221;<\/p>\n<p>According to him, following up on the investigation, the Q &amp; Q Control<br \/>\nServices Nigeria Limited was further requested to furnish the EFCC with<br \/>\nall the shipping documents in respect of the ship-to-ship transfer.<\/p>\n<p>He told the Court that the analysis of the shipping documents further<br \/>\nconfirmed that the defendant only imported 4,850MT contrary to the claim<br \/>\nof the defendant.<\/p>\n<p>Further testifying, he said, &#8220;We also found out that Staco Insurance<br \/>\npurportedly issued a certificate of marine insurance for this<br \/>\ntransaction.<\/p>\n<p>&#8220;We made a copy of it and wrote an investigation activities letter to<br \/>\nthe insurance company attaching the said certificate with number<br \/>\n0047851.<\/p>\n<p>&#8220;They acknowledged receipt and responded to our request in writing in<br \/>\nwhich they confirmed that the attached certificate was forged.<\/p>\n<p>&#8220;However, also attached to their response was a copy of the authentic<br \/>\ncertificate of insurance with the same number issued to the defendant.<\/p>\n<p>&#8220;We studied the response and wrote another letter to Staco Insurance Plc<br \/>\nrequesting for the company to furnish us with the documents submitted by<br \/>\nthe defendant for the purpose of acquiring the insurance.&#8221;<\/p>\n<p>Bawa told the Court that the insurance company responded in writing<br \/>\nattaching copies of the requested documents, including the proforma<br \/>\ninvoice given to the defendant by Petrocam.<\/p>\n<p>He, thereafter, identified the copies of the letters written to the<br \/>\ninsurance company and the responses received by the EFCC.<\/p>\n<p>However, when the prosecution sought to tender them in evidence, the<br \/>\ndefence team raised objection to their &#8220;admissibility and tendering&#8221;.<\/p>\n<p>Thereafter, Justice Balogun adjourned till February 2, 2021 for &#8220;ruling<br \/>\nand continuation of hearing&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"mail-message-footer spacer collapsible\"><\/div>\n<\/div>\n<div id=\"m#msg-f:1689990708533225836\" class=\"mail-message expanded\">\n<div class=\"mail-message-header spacer\"><\/div>\n<div class=\"mail-message-content collapsible zoom-normal mail-show-images \">\n<div class=\"clear\">\n<p>Kwara Bursary Scam: N100million Shared Without List of Beneficiaries<\/p>\n<p>Trial in the alleged mismanagement of scholarship funds to the tune of<br \/>\nN100million involving the immediate past chairperson of Kwara State<br \/>\nScholarship Board, Hajia Fatimoh Yusuf and two other principal officers<br \/>\nof the Board resumed on Tuesday, January 26, 2021 with a prosecution<br \/>\nwitness, Lawal Abdulwahab, telling Justice Sikiru Oyinloye of the Kwara<br \/>\nState High Court sitting in Ilorin that, he never saw the list of the<br \/>\nbeneficiaries of the 2018 bursary allowances.<\/p>\n<p>The Ilorin Zonal Office of the Economic and Financial Crimes Commission,<br \/>\nEFCC, is prosecuting Hajia Yusuf, alongside the Executive Secretary of<br \/>\nthe Board, Fatai Lamidi and its Accountant, Ajewole Stephen, on a seven<br \/>\ncount charge bordering on stealing and fraudulent diversion of public<br \/>\nfunds.<\/p>\n<p>The three officers of the Board allegedly diverted state funds to the<br \/>\ntune of N100million earmarked by government of the Kwara State in 2017<br \/>\nand 2018 for payment of bursary allowances to students of the state in<br \/>\nvarious tertiary institutions.<\/p>\n<p>Testifying, Abdulwahab stated that his bank was commissioned to be in<br \/>\ncharge of payment of the allowances to respective beneficiaries of the<br \/>\nscheme, but was never provided with the list.<\/p>\n<p>Abdulwahab, who was the Head of Operations in a new generation bank<br \/>\ntestified as PW 8.<\/p>\n<p>He said: &#8220;My Lord, sometime in 2018, the management of the Scholarship<br \/>\nBoard approached our bank for cheque discounting in the payment of<br \/>\nbursary allowances to students of Kwara origin studying in various<br \/>\ntertiary institutions. The bank managing director and I held a meeting<br \/>\nwith the management of Scholarship Board where we agreed to charge the<br \/>\nsum of N100 (one hundred naira) from each of the cheque as interest. We<br \/>\nwere to pay cash of N5, 000 (five thousand naira only) to ten thousand<br \/>\nStudents.<\/p>\n<p>The PW8 told the court that officials of the bank followed personnel of<br \/>\nthe Board to Ladoke Akintola University of Technology, LAUTECH,<br \/>\nOgbomoso, but had what he described as &#8216;terrible experience&#8217;.<\/p>\n<p>According to him, the place was rowdy and insecure. Abdulwahab stated<br \/>\nthat a report of what happened was forwarded to the bank following which<br \/>\nthe bank threatened to back out, a decision he said led to another<br \/>\narrangement of providing cash without the officials of the bank<br \/>\nfollowing them to field.<\/p>\n<p>Testifying further, the witness narrated how the bank provided cash of<br \/>\nN5, 000 to ten thousand students and how the Scholarship Board&#8217;s<br \/>\nmanagement issued them cheque in return. He told the court that the<br \/>\ncheques were not forged.<\/p>\n<p>Under cross-examination, Abdulwahab insisted that he neither sighted the<br \/>\nlist of beneficiaries at the Office of the Kwara State Scholarship Board<br \/>\nnor at the EFCC where he was invited to give statement on the matter.<\/p>\n<p>The witness stated that all that transpired between his bank and the<br \/>\nmanagement of the Kwara State Scholarship Board were normal banking<br \/>\nstandards, which followed the due process.<\/p>\n<p>The prosecution witness further stressed the fact that his bank&#8217;s cash<br \/>\nofficials no longer followed personnel of the Scholarship Board to the<br \/>\nfield after that experience at LAUTECH, for security reasons.<\/p>\n<p>After his testimonies, Justice Oyinloye discharged the witness and<br \/>\nadjourned till February 17, 2021 for further hearing.<\/p>\n<\/div>\n<\/div>\n<div class=\"mail-message-footer spacer collapsible\"><\/div>\n<\/div>\n<!-- AddThis Advanced Settings generic via filter on the_content --><!-- AddThis Share Buttons generic via filter on the_content --><!-- AddThis Related Posts generic via filter on the_content -->","protected":false},"excerpt":{"rendered":"<p>The ongoing trial of Abubakar Ali Peters, chairman, Nadabo Energy, for an alleged N1.4 billion oil subsidy fraud, continued on January 26, 2021 with Justice C.A.
