{"id":78573,"date":"2021-02-18T17:12:35","date_gmt":"2021-02-18T16:12:35","guid":{"rendered":"http:\/\/pointblanknews.com\/pbn\/?p=78573"},"modified":"2021-02-18T17:12:35","modified_gmt":"2021-02-18T16:12:35","slug":"agf-customs-dragged-to-court-over-n56-million-contract-alleged-violations","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/news\/agf-customs-dragged-to-court-over-n56-million-contract-alleged-violations\/","title":{"rendered":"AGF, Customs Dragged To Court Over N56 Million Contract Alleged  Violations"},"content":{"rendered":"<div dir=\"ltr\">GWWIL Communication Limited (GCL) has approached a Federal High Court<\/div>\n<div dir=\"ltr\">Sitting in Abuja, accusing the Nigerian Customs Service (NCS), and the<\/div>\n<div dir=\"ltr\">Attorney General of the Federation, AGF, of contract violations.<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\">The contract\u2019s title \u201cRenovation and furnishing of the Nigerian Customs<\/div>\n<div dir=\"ltr\">Service Area Controller\u2019s Quarters including landscaping at Bauchi,<\/div>\n<div dir=\"ltr\">Bauchi State\u201d was awarded on December 24, 2014 for the sum of<\/div>\n<div dir=\"ltr\">N56,950,000 million.<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\">The Claimant\u2019s counsels, Mr Efekemdiaye Daniel Esq., Colins Marshall<\/div>\n<div dir=\"ltr\">Esq., and Abioye Damilola Esq. are urging the court to examine the<\/div>\n<div dir=\"ltr\">infractions.<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\">According to the case fact in the file available to Pointblanknews.com,<\/div>\n<div dir=\"ltr\">the Claimant alleges that the NCS board failed in its contractual<\/div>\n<div dir=\"ltr\">obligations to pay the balance of 85 percent of the contract two years<\/div>\n<div dir=\"ltr\">after the project\u2019s completion and hand over, which constitutes a breach<\/div>\n<div dir=\"ltr\">of agreement.<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\">GCL in the court papers said they have received only 15 per cent of the<\/div>\n<div dir=\"ltr\">contract sum less mobilization fee upon presentation of insurance bond.<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\">The alleged infractions include the unilateral downward review of<\/div>\n<div dir=\"ltr\">contract term of an already executed project adjudged satisfactory by<\/div>\n<div dir=\"ltr\">the respondents, two years after completion.<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\">The GWWIL Communication Limited is asking to court to declare the<\/div>\n<div dir=\"ltr\">purported review by the board, dated November 21, 2017 illegal, null and<\/div>\n<div dir=\"ltr\">void.<\/div>\n<div dir=\"ltr\">Other reliefs sought include \u201cthe payment of N26,849,463.50 million to<\/div>\n<div dir=\"ltr\">the claimant in line with the agreement dated February 27, 2015 that is<\/div>\n<div dir=\"ltr\">in tandem with the Bill of Quantities.<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\">\u201cPlus, an accrued interest the said amount had generated from the date<\/div>\n<div dir=\"ltr\">the NCS Board issued its first certificate of satisfactory completion of<\/div>\n<div dir=\"ltr\">job\/ handing over at the rate of the 20% up till the date of final<\/div>\n<div dir=\"ltr\">award.\u201d<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\">The claimant also seeks an order directing the NCS Board to pay the sum<\/div>\n<div dir=\"ltr\">of N47,669,892 million as special damages as well as an order mandating<\/div>\n<div dir=\"ltr\">the board to pay the sum of N2,847,500 million being retention fee<\/div>\n<div dir=\"ltr\">withheld by the NCS.<\/div>\n<!-- AddThis Advanced Settings generic via filter on the_content --><!-- AddThis Share Buttons generic via filter on the_content --><!-- AddThis Related Posts generic via filter on the_content -->","protected":false},"excerpt":{"rendered":"<p>GWWIL Communication Limited (GCL) has approached a Federal High Court Sitting in Abuja, accusing the Nigerian Customs Service (NCS), and the Attorney General of the Federation, AGF, of contract violations.&hellip;<!-- AddThis Advanced Settings generic via filter on wp_trim_excerpt --><!-- AddThis Share Buttons generic via filter on wp_trim_excerpt --><!-- AddThis Related Posts generic via filter on wp_trim_excerpt --><\/p>\n","protected":false},"author":1,"featured_media":78574,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_lmt_disableupdate":"","_lmt_disable":"","footnotes":""},"categories":[5],"tags":[],"class_list":["post-78573","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-news"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v26.8 -
