‘Socio-Economic Rights and Accountability Project (SERAP) has urged<\/div>\n
\n
President Muhammadu Buhari to use his “good offices and leadership
\nposition to urgently review and rescind your reported approval for
\nsecurity agencies to access people’s personal details via NIN-SIM
\nlinkage without due process of law.”<\/p>\n

SERAP is also urging the president to “send executive bills to the
\nNational Assembly to repeal and reform all laws, which are inconsistent
\nand incompatible with Nigerians’ rights to privacy, dignity and
\nliberty.”<\/p>\n

SERAP’s letter followed reports that some security agencies have
\nreceived presidential approval to access people’s personal details via
\nthe database of the National Identity Management Commission in the
\ncourse of carrying out their duties.<\/p>\n

In the letter dated 5 February 2022 and signed by SERAP deputy director
\nKolawole Oluwadare, the organisation said: “If your reported approval is
\nnot rescinded, millions of law-abiding Nigerians may feel that their
\nprivate lives are the subject of constant surveillance.”<\/p>\n

SERAP said: “The interference entailed by unlawfully or arbitrarily
\naccessing people’s personal details is far-reaching and must be
\nconsidered to be particularly serious.”<\/p>\n

According to SERAP, “The reported approval to allow security agencies to
\naccess people’s personal details via NIN-SIM linkage without due process
\nof law directly interferes with the privacy, dignity and liberty of
\nindividuals.”<\/p>\n

SERAP also said, “Interference with an individual’s right to privacy is
\nnot permissible if it is unlawful or arbitrary.”<\/p>\n

The letter, read in part: “The power to access individual’s details
\nraises serious concerns as to their arbitrary use by the authorities
\nresponsible for applying them in a manner that reduces human rights and
\ndemocratic principles by the monitoring and surveillance of millions of
\nNigerians.”<\/p>\n

“It is crucial to rescind the approval, and respect the autonomy of
\nindividuals to receive and share information of a personal nature
\nwithout interference from the authorities, if unintended adverse
\nconsequences are to be avoided.”<\/p>\n

“The risk of arbitrary or abusive interference shows the importance for
\nyour government to comply fully with the requirements of legality,
\nnecessity and proportionality.”<\/p>\n

“The right to privacy allows Nigerians to hold opinions and exercise
\nfreedom of expression without arbitrary or illegal interference and
\nattacks.”<\/p>\n

“Private conversations of individuals – which belong to their intimate
\nsphere and contribute to their personal development – also enjoy strong
\nlegal protection and can only be limited based on the principles of
\nlegality, necessity and proportionality.”<\/p>\n

“The reported presidential approval to security agencies does not align
\nwith the principle that any restriction on human rights capable of
\nlimitation should be the least intrusive means possible, and shall be
\nnecessary and proportionate to the benefit sought.”<\/p>\n

“Violations or abuses of the right to privacy might affect the enjoyment
\nof other human rights, including the right to freedom of expression and
\nto hold opinions without interference.”<\/p>\n

“SERAP notes that the right to privacy can enable the enjoyment of other
\nrights and the free development of an individual’s personality and
\nidentity, and an individual’s ability to participate in political,
\neconomic, social and cultural life.”<\/p>\n

“In relation to the requirement of legality, any limitation must be
\nexpressly, exhaustively, precisely, and clearly provided for in a law in
\nthe formal and material sense. It is not enough that the restrictions be
\nformally approved by the president or by any other competent body: they
\nmust also be sufficiently clear, accessible and predictable.”<\/p>\n

“Similarly, measures restricting enjoyment of the right to privacy must
\ncomply with the principle of proportionality, meaning that they must not
\nunduly interfere with other rights of the persons targeted.”<\/p>\n

“In the digital age, protecting the right to privacy requires
\nexceptional attention. While acknowledging the challenging issues that
\nyour approval may seek to address, SERAP is seriously concerned that
\nthis may be used as a pretext by security agencies to violate Nigerians’
\nright to privacy and other related human rights.”<\/p>\n

“The undermining of the universality of fundamental human rights,
\nalongside the potential encroachment upon the enjoyment of the right to
\nprivacy raised by the presidential approval, suggests the urgent need to
\nreview the matter, and rescind your approval, consistent with
\nconstitutional and international standards.”<\/p>\n

“SERAP notes that the relationship between data principals and the
\nauthorities involves a power imbalance. Nigeria ought to provide the
\nleadership in developing a data protection framework that is fully
\nconsistent and compatible with the protection of the fundamental and
\ninalienable right to privacy.”<\/p>\n

“According to reports, some security agencies have received your
\napproval to access people’s personal details via the database of the
\nNational Identity Management Commission in the course of carrying out
\ntheir duties. The Minister of Communications and Digital Economy, Isa
\nPantami reportedly conveyed the approval to the relevant security
\nagencies.”<\/p>\n

“Mr Pantami also reportedly stated that the approval would enhance
\nsecurity as it would help security operatives to go after kidnappers and
\nother criminals.”<\/p>\n

“The approval would now allow security agencies to access the data of
\nthe over 73 million Nigerians who have linked their National Identity
\nNumber with their SIM, and other people who may do so.”<\/p>\n

“While the effectiveness of the fight against serious crime may depend
\nto a great extent on the use of modern investigation techniques, such an
\nobjective of general interest, however fundamental it may be, cannot in
\nitself justify the unlawful or arbitrary interference with the right to
\nprivacy.”<\/p>\n

“Unlawful or arbitrary access to people’s personal details would
\ncontravene section 37 of the Nigerian Constitution 1999 (as amended),
\narticle 17 of the International Covenant on Civil and Political Rights,
\nand article 5 of the African Charter on Human and Peoples’ Rights, which
\nprotect against arbitrary or unlawful interference with one’s privacy.”<\/p>\n

“Any constraints upon the right to privacy must strictly comply with the
\nprinciples of legality, necessity and proportionality. These
\nrequirements are included in the Nigerian Constitution and the human
\nrights treaties to which Nigeria is a state party.”<\/p>\n

“We would be grateful if the recommended measures are taken within 7
\ndays of the receipt and\/or publication of this letter. If we have not
\nheard from you by then, SERAP shall take all appropriate legal actions
\nto compel your government to comply with our request in the public
\ninterest.”<\/p>\n

The letter was copied to Mr Abubakar Malami, SAN, Attorney General of
\nthe Federation and Minister of Justice, and Mr Isa Pantami, Minister of
