{"id":92762,"date":"2022-03-13T13:36:58","date_gmt":"2022-03-13T12:36:58","guid":{"rendered":"http:\/\/pointblanknews.com\/pbn\/?p=92762"},"modified":"2022-03-13T13:36:58","modified_gmt":"2022-03-13T12:36:58","slug":"nin-sim-linkage-serap-sues-buhari-over-security-agencies-access-to-subscribers-details","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/news\/nin-sim-linkage-serap-sues-buhari-over-security-agencies-access-to-subscribers-details\/","title":{"rendered":"NIN-SIM linkage: SERAP sues Buhari over \u2018security agencies\u2019 access to subscribers\u2019 details\u2019"},"content":{"rendered":"<div id=\"m#msg-f:1727172416443917666\" class=\"mail-message expanded\">\n<div class=\"mail-message-header spacer\" style=\"text-align: justify;\">Socio-Economic Rights and Accountability Project (SERAP) has filed a lawsuit against President Muhammadu Buhari over \u201cthe failure to review and rescind his reported approval for security agencies to access people\u2019s personal details via NIN-SIM linkage without due process of law.\u201d<\/div>\n<div class=\"mail-message-content collapsible zoom-normal mail-show-images \" style=\"text-align: justify;\">\n<div class=\"clear\">\n<div dir=\"auto\">\nPresident Buhari had in February reportedly given his approval for some security agencies to access the database of the National Identity Management Commission in the course of carrying out their duties.<\/p>\n<p>But in the suit number FHC\/L\/CS\/448\/2022 filed last Friday at the Federal High Court, Lagos, SERAP is asking the court to determine \u201cwhether the approval for security agencies to access people\u2019s personal details via the National Identification Number [NIN] without due process is consistent with the principles of legality, necessity, and proportionality.\u201d<\/p>\n<p>SERAP is asking the court for \u201can order setting aside President Buhari\u2019s approval for security agencies to access people\u2019s personal details via NIN-SIM linkage without due process of law, as this amounts to violations of private and digital communication rights, right to family life, human dignity and personal liberty.\u201d<\/p>\n<p>SERAP is also asking the court for \u201can order of perpetual injunction restraining the Federal Government or any other authority, persons or group of persons from unlawfully accessing people\u2019s personal details via NIN-SIM linkage without due process of the law.\u201d<\/p>\n<p>In the suit, SERAP is arguing that: \u201cIf President Buhari\u2019s approval is not rescinded, millions of law-abiding Nigerians may feel that their private lives are the subject of constant surveillance.\u201d<\/p>\n<p>SERAP is also arguing that, \u201cIn the digital age, protecting the right to privacy requires exceptional attention.
