{"id":92867,"date":"2022-03-16T13:24:11","date_gmt":"2022-03-16T12:24:11","guid":{"rendered":"http:\/\/pointblanknews.com\/pbn\/?p=92867"},"modified":"2022-03-16T13:24:11","modified_gmt":"2022-03-16T12:24:11","slug":"court-declines-nnamdi-kanus-request-for-dss-boss-oral-evidence-on-health-status","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/news\/court-declines-nnamdi-kanus-request-for-dss-boss-oral-evidence-on-health-status\/","title":{"rendered":"Court declines Nnamdi Kanu\u2019s request for DSS boss oral evidence on health status"},"content":{"rendered":"<div dir=\"auto\" style=\"text-align: justify;\">A Federal High Court, Abuja, on Wednesday, dismissed a motion filed by leader of the proscribed Indigenous People of Biafra, Nnamdi Kanu, for the Director-General of the Department of States Services to give oral evidence on his state of health.<\/p>\n<p>Justice Taiwo Taiwo, in the ruling, held that fundamental rights cases are special cases \u201csui generis\u201d which mode of commencement is affidavit evidence as prescribed under Order 2, Rule 2 of the Fundamental Human Right Enforcement Procedure Rules, 2009.<\/p>\n<p>Justice Taiwo said that though there were various modes of commencement of action, including fundamental right cases, Kanu (applicant) chose to commence his \u201cunder the Fundamental Right Enforcement Procedure Rules that stipulate affidavit evidence.\u201d<\/p>\n<p>He ruled that after carefully perusing all the affidavits of the applicant and the respondents before him, he was of the view that there were no irreconcilable conflicts in the affidavits.<\/p>\n<p>The judge, therefore, declined to grant Kanu\u2019s application and was accordingly dismissed.<\/p>\n<p>Taiwo adjourned the matter until April 13 for the hearing of the substantive application.<\/p>\n<p>Justice Taiwo had, on March 7, fixed today for the ruling on Kanu\u2019s motion, filed by his lawyer, Maxwell Opara.<\/p>\n<p>Opara, in the application, prayed the court to direct the DSS DG and the IPOB leader to appear before it to give oral evidence regarding the health condition of the latter.<\/p><\/div>\n<div dir=\"auto\" style=\"text-align: justify;\"><\/div>\n<div dir=\"auto\">Kanu, through his lawyer, had, in a fundamental rights enforcement suit marked: FHC\/ABJ\/CS\/1585\/2021, sued the DG of DSS and the office as 1st and 2nd respondents respectively.<\/p>\n<p>He also joined the Attorney-General of the Federation (AGF) as 3rd respondent in the suit dated and filed Dec. 13, 2021.<\/p>\n<p>Opara had alleged that the health of his client was deteriorating in the DSS custody, among others.<\/p>\n<p>Opara had filed a motion on notice dated Feb. 14 and brought pursuant to Section 116 of the Evidence Act.<\/p>\n<p>He argued, in the last adjourned date, that there were conflicts in the counter affidavit filed by the DSS and that only oral evidence of the DG and Kanu could clarify the issue.<\/p>\n<div class=\"yj6qo\" style=\"text-align: justify;\"><\/div>\n<div class=\"adL\" style=\"text-align: justify;\"><\/div>\n<\/div>\n<!-- AddThis Advanced Settings generic via filter on the_content --><!-- AddThis Share Buttons generic via filter on the_content --><!-- AddThis Related Posts generic via filter on the_content -->","protected":false},"excerpt":{"rendered":"<p>A Federal High Court, Abuja, on Wednesday, dismissed a motion filed by leader of the proscribed Indigenous People of Biafra, Nnamdi Kanu, for the Director-General of the Department of States&hellip;<!-- AddThis Advanced Settings generic via filter on wp_trim_excerpt --><!-- AddThis Share Buttons generic via filter on wp_trim_excerpt --><!-- AddThis Related Posts generic via filter on wp_trim_excerpt --><\/p>\n","protected":false},"author":1,"featured_media":92868,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_lmt_disableupdate":"","_lmt_disable":"","footnotes":""},"categories":[5],"tags":[],"class_list":["post-92867","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-news"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v26.8 -
