{"id":95238,"date":"2022-05-23T19:27:28","date_gmt":"2022-05-23T18:27:28","guid":{"rendered":"http:\/\/pointblanknews.com\/pbn\/?p=95238"},"modified":"2022-05-23T19:27:28","modified_gmt":"2022-05-23T18:27:28","slug":"2023-emefiele-makes-a-u-turn-withdraws-suit-against-inec-agf","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/exclusive\/2023-emefiele-makes-a-u-turn-withdraws-suit-against-inec-agf\/","title":{"rendered":"2023: Emefiele makes a u-turn, withdraws suit against INEC, AGF"},"content":{"rendered":"<div id=\"m#msg-f:1733637915469463093\" class=\"mail-message expanded\">\n<div class=\"mail-message-header spacer\" style=\"text-align: justify;\">The Governor of Central Bank of Nigeria, Godwin Emefiele, on Monday, withdrew the suit he filed against the Independent National Electoral Commission, INEC and the Attorney-General of the Federation over his presidential ambition.<\/div>\n<div class=\"mail-message-content collapsible zoom-normal mail-show-images \" style=\"text-align: justify;\">\n<div class=\"clear\">\n<div dir=\"auto\">\n<div dir=\"auto\">\nEmefiele, through his counsel, S.T. Maliki, told Justice Ahmed Mohammed that a notice of discontinuance had been filed and served on the defendants in the matter.<\/p>\n<p>The development occurred shortly after the matter was called.<\/p>\n<p>Maliki, who held the brief of Chief Mike Ozekhome, SAN, said though the matter was scheduled for mention, they had Emefiele\u2019s instruction to withdraw the suit.<\/p>\n<p>\u201cPursuant to the instruction of the plaintiff (Emefiele), we filed a notice of discontinuance dated and filed May16, 2022<\/p>\n<p>\u201cAnd the said notice of discontinuance was served on all the defendants on that said date of May 16, 2022, which proof of service is before your lordship,\u201d Maliki said.<\/p>\n<p>The lawyer said of all the defendants, only the 4th and 5th defendants filed a counter-affidavit in response to the plaintiff\u2019s amended originating summons, after the notice of withdrawal had been served on them.<\/p>\n<p>He prayed the court to discontinue the suit and make an order striking it out, issues having not been joined by parties in the suits, citing Order 50 of the rules of this court.<\/p>\n<p>Although lawyer to the 4th defendant, John Aikpokpo-Martins, opposed Emefiele\u2019s intention to withdraw the suit, he urged the court to dismiss the suit with N1.5 million cost.<\/p>\n<p>However, counsel for the 2nd and 3rd defendants, Chris Nevo and T. J. Adi respectively did not object to the withdrawal notice.<\/p>\n<p>For Nevo, he asked the court to award a N1 million cost against Emefiele.<\/p>\n<p>In his ruling, Justice Mohammed held that Emefiele had the right to file the notice of withdrawal. He said the notice of discontinuance was valid and accordingly struck out.<\/p>\n<p>Pointblanknews.com had reported that Emefiele, through his lawyer, Ozekhome, had approached the court.<\/p>\n<p>He had approached the court with an ex-parte motion, seeking the court\u2019s interpretation as to whether he could run for the 2023 presidential primary while he holds as governor of CBN.<\/p>\n<p>He had sought an order of the court, restraining the Federal Government from removing him from office over his presidential ambition, pending the hearing and determination of the substantive matter.<\/p>\n<p>He also prayed the court to stop the INEC from taking any action against him in the bid to contest in the presidential primary by virtue of his office.<\/p>\n<p>The CBN governor made the prayers in an ex-parte motion dated and filed on May 9 by his lawyer, seeking an order of maintenance of status quo ante bellum pending the hearing and determination of the substantive suit.<\/p>\n<p>Emefiele, in the suit, sued the INEC and the AGF as 1st and 2nd defendants respectively.<\/p>\n<p>But Justice Mohammed, on May 12, also joined the Peoples Democratic Party (PDP), and two other lawyers, for themselves and on behalf of members of Save Nigeria, Our Fatherland, as 3rd, 4th and 5th defendants respectively.<\/p><\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"mail-message-footer spacer collapsible\" style=\"text-align: justify;\"><\/div>\n<\/div>\n<!-- AddThis Advanced Settings generic via filter on the_content --><!-- AddThis Share Buttons generic via filter on the_content --><!-- AddThis Related Posts generic via filter on the_content -->","protected":false},"excerpt":{"rendered":"<p>The Governor of Central Bank of Nigeria, Godwin Emefiele, on Monday, withdrew the suit he filed against the Independent National Electoral Commission, INEC and the Attorney-General of the Federation over&hellip;<!-- AddThis Advanced Settings generic via filter on wp_trim_excerpt --><!-- AddThis Share Buttons generic via filter on wp_trim_excerpt --><!-- AddThis Related Posts generic via filter on wp_trim_excerpt --><\/p>\n","protected":false},"author":1,"featured_media":94754,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_lmt_disableupdate":"","_lmt_disable":"","footnotes":""},"categories":[17],"tags":[],"class_list":["post-95238","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-exclusive"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v26.8 -
