{"id":96310,"date":"2022-06-24T16:01:43","date_gmt":"2022-06-24T15:01:43","guid":{"rendered":"http:\/\/pointblanknews.com\/pbn\/?p=96310"},"modified":"2022-06-24T16:01:43","modified_gmt":"2022-06-24T15:01:43","slug":"electoral-act-supreme-court-strikes-out-buhari-and-agf-malamis-suit-on-section-8412","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/exclusive\/electoral-act-supreme-court-strikes-out-buhari-and-agf-malamis-suit-on-section-8412\/","title":{"rendered":"Electoral Act: Supreme Court Strikes Out Buhari and AGF Malami\u2019s Suit on Section 84(12)"},"content":{"rendered":"<div id=\"m#msg-f:1736520995136695055\" class=\"mail-message expanded\">\n<div class=\"mail-message-header spacer\" style=\"text-align: justify;\">Nigeria\u2019s Supreme Court on Friday struck out a suit filed by President Muhammad Buhari and the Attorney-General of the Federation, Abubakar Malami, challenging the constitutionality of section 84(12) of the Electoral Act.<\/div>\n<div class=\"mail-message-content collapsible zoom-normal mail-show-images \" style=\"text-align: justify;\">\n<div class=\"clear\">\n<div dir=\"auto\">\n<div dir=\"auto\">A panel of seven justices of the court, led by Musa Dattijo-Muhammad, unanimously struck out the suit, describing it as an abuse of court process.The section provides that \u201cNo political appointee at any level shall be a voting delegate or be voted for at the convention or congress of any political party for the purpose of the nomination of candidates for any election.\u201d<\/p>\n<p>Justice Aokmaye Agim, who delivered the lead judgement, held that Buhari, having earlier assented to section 84 (12) of the Electoral Act 2022, cannot turn around to approach the court to strike it down.<\/p>\n<\/div>\n<div dir=\"auto\">\u201cThere is no provision in the constitution that vests the president the power to challenge the constitutionaility or desirability of a legislation after he has assented or denied his assent.
