A Federal High Court sitting in Kano has set aside, its interim injunction halting Kano State Governor, Abdullahi Ganduje, from borrowing N10 billion for CCTV installation.<\/p>\n
The Kano First Forum (KFF) had earlier filed a suit challenging the approval for the loan granted by the Kano State House of Assembly.<\/p>\n
The respondents in the suit are the Governor, Attorney-General of Kano State, Commissioner of Finance, and Speaker, Kano State House of Assembly.<\/p>\n
Others are Access Bank, Federal Ministry of Finance, Debt Management Office, and Fiscal Responsibility Commission.<\/p>\n
The court had earlier restrained the government from borrowing the money for the CCTV installation.<\/p>\n
Justice Abdullahi Liman vacated the interim order after the respondents counsel, Muhammad Dahuru\u2019s applied for setting it aside.<\/p>\n
Justice Liman relied on the basis shown by the applicant\u2019s only misrepresentation and concealment of fact materials to vacate the order.<\/p>\n
He transferred the case to vacation court as the Federal High Court would begin the annual vacation on Friday.<\/p>\n
He stated that the adjourned date would be communicated to both parties.<\/p>\n
Earlier, counsel to the respondents, Muhammad Dahuru, filed a motion, dated July 7, urging the court to discharge and set aside the earlier order it granted against his clients.<\/p>\n
He argued: \u201cAs a result of security challenges based on banditry and kidnapping in the country, which needed to be seriously addressed for the protection of lives and properties.\u201d<\/p>\n
Counsel to the applicant, Badamasi Suleiman, had challenged the application filed by the respondent seeking to discharge the interim order it earlier granted stopping the loan.<\/p>\n
The applicants, in their prayers, challenged the state government without complying with Debt Management Office Establishment Act, 2003, Fiscal Responsibility Act, 2007 and Laws of Kano State, 1968.<\/p>\n","protected":false},"excerpt":{"rendered":"
