OPEN LETTER TO THE INSPECTOR-GENERAL OF POLICE

RE: PUBLICATION IN SATURDAY VANGUARD VOL 13: NO. 653 DATED 20 TH OF APRIL, 2009 TITLED “GIWA-AMU: LAWYER TO AGENT OF POINT BLANK NEWS DOCKED FOR FALSE INFORMATION”.
We act as Solicitors to CHIEF A.G GIWA-AMU who is equally our Head of Chambers (hereinafter referred to as “Head of Chambers”) and on whose direct instructions we write.
Our attention was drawn to the defamatory publication made against our Head of Chambers by the Vanguard Media Limited, publisher of Vanguard Newspaper in conspiracy with Mr. Sam Amuka who is said to be the Chairman of the said media house.
The involvement of Vanguard Media Limited and Mr. Sam Amuka in the said publication can best be described as malicious. We make bold to say that the said publication is defamatory and emanating from perverse and perfidious minds.
We state our case as follows:
- It is a fact that Mrs. Oyindamola Sam Amuka, wife of Mr. Sam Amuka, publisher of the Vanguard Newspaper was arrested on the 20 th day of July, 2007 for the following offences;
- Human Trafficking contrary to the Laws of the Federal Republic of Nigeria

- Suspected murder contrary to section 306 of the Criminal Code Law, Laws of Lagos State.
- Engaging in criminal charms contrary to section 210 and 213 of the Criminal Code Law, Laws of Lagos State.
- That it is a fact that Sgt. Ogadima Eze, Sgt. Patrick Arawunmi and Woman Police Toyin Omolaja effected the arrest of the said Mrs. Oyindamola Sam Amuka.
- That it is a fact that photographs, video recordings, video films, C.D plates and other items of evidential value where incidented as proof of evidence against the said Mrs. Oyindamola Sam Amuka.
- That it is a fact that the said Mrs. Oyindamola Sam Amuka was in police custody for 3 (three) days and was only released by Superintendent of Police Babatunde Jonathan, who was the head of D13 Section, State Criminal Investigation Department, Panti, Yaba, Lagos State, which section investigated this matter, wherein Sgt. Ogadima Eze, Sgt. Patrick Arawunmi, Woman Police Toyin Omolaja served as police detectives.
- It is a fact that Mrs. Oyindamola Sam Amuka was only released by the Police after she parted with N4,000,000.00 (Four Million Naira) which was received by Superintendent of Police Babatunde Jonathan, (a policeman) as confirmed in his confessional statement, based on his arrest consequent upon a complaint by our office on behalf of Mr. Steve Ogwu Chinuwa.
- It is a fact that our client, Mr. Steve Ogwu Chinuwa was co-opted into the police investigative team as a journalist and observed the dastardly and gruesome activities of Mrs. Oyindamola Sam Amuka and her co-ritualist.
- That it is a fact that upon being paid N4, 000,000.00 (Four Million Naira) by Mrs. Oyindamola Sam Amuka, Superintendent of Police, Babatunde Jonathan, destroyed the entire police case file, video films, C.D plate and other items of evidential values while Mrs. Oyindamola Sam Amuka fled to London.

- That it is a fact that the entire rituals, human sacrifice was done with the clear intent to obtain spiritual healing for Mr. and Mrs. Sam Amuka’s sick son who was/is in the United Kingdom.
- In proof of these allegations above mentioned, we hereby attach your police report dated 31 st December, 2008 signed by ACP
Olugbenga Adeyanju.
Our Chief A.G Giwa-Amu’s involvement which necessitated the scandalous publication in Vanguard of 24 th February, 2009 and 18 th April, 2009, Vol. 25 No. 60789 and Vol. 13 No. 653 respectively, which defamatory publication was done in conspiracy with Abdulrahman Olajide Akano (Commissioner of Police) is simply that our Head of Chambers is the defence Counsel/Solicitor to Mr. Steve Ogwu Chinuwa, who was subsequently arraigned in court in the bid by the police to shield, protect, conduce to, connived at and conspire with Mr. and Mrs. Sam Amuka to scuttle the cause of justice.
Find attach herewith are pictures of evidential value which shall be referred to as annexures A, B, C, D, E, F and G.
Annexure A is the photograph of Mrs. Oyindamola Sam Amuka in handcuffs having been arrested by your officers; Annexure B is the photograph of Mrs. Oyindamola Sam Amuka in handcuffs with her co-ritualist and conspirators; Annexure C is the photograph of Mrs. Oyindamola Sam Amuka performing rituals with an earthen pot in her hands; Annexure D is the photograph of the alleged beheaded body of the deceased 11years old boy; Annexure E is the photograph of Mrs. Oyindamola Sam Amuka in handcuffs with another ritualist in handcuffs; Annexure F is the photograph of Mrs. Oyindamola Sam Amuka with your police officers at the point of arrest and the picture of the vehicle which she drove voluntarily to Igbalu village in Ikorodu Local Government Area of Lagos State for the purpose of the human sacrifice, which vehicle (Kia Jeep) was/is duly registered in the name of Mr. Sam Amuka Pemu, with Lagos State registration No. BF 970 EPE; Annexure G shows Mrs. Oyindamola Sam Amuka in the ritual regalia “praying” in offering the 11 years old boy for human sacrifice.
Mr. Inspector-General of Police, sir, faced with this overwhelming evidence, the Lagos State Police Command chose the path of dishonor by charging the journalist, our client, Mr. Steve Ogwu

Chinuwa to court in charge No. MIK/7/18/2009 Commissioner of police V. Steve Chinuwa and Alhaji Rasheed Alayande.
Please be informed that the said Alhaji Rasheed Alayande Akano (the 2 nd Defendant in the charge No. MIK/7/18/2009) is the younger brother to Commissioner of Police, Abdulrahman Olajide Akano’s who at all material times engaged in the criminal act which is alleged against Mrs. Oyindamola Sam Amuka. Those who plant in the vineyard of mendacity shall reap sour grapes.
The above charge/matter is coming up for hearing on the 27 th day of May 2009 before the Magistrate Court 19, Ikeja, Lagos State. Please be rest assured that it is in fact the Nigerian Police Force on trial not our client.
With regards to our Chief Giwa-Amu, Lawyer to Steve Chinuwa-Ogwu docked for false information as published in the Vanguard Newspaper of April 18 2009, Vol. 13: No. 653 titled “ Giwa-Amu: Lawyer to agent of Point Blank News docked for false information”.
We wish to state unequivocally as follows:
- That it is not in doubt, that our client, one Wale Amoo was murdered on the 4 th October, 2002.
- That it is equally not in doubt that one Alhaji Ganiyu Omoola was the prime suspect in that case per petition written by the law firm of Akin Duyilemi & Co. of 51, Ayangburen Road, Ikorodu, Lagos State then on behalf of the Estate of the said Wale Amaoo.
- That it is not in doubt that your Homicide Section, then headed by Uzor Amakulor Deputy Commissioner of Police headed the investigation and then opined that no suspect could be found or arrested and as such no case of murder could be made out, even when the corpse riddled with gunshots was yet to be buried. See Charge Register No. CR 456 and Station Dairy Entry No. 197/of29/11/2002.
- That when our office was briefed for the Estate of the Late Wale Amaoo, we then took steps to assist the police to find the suspects, prosecute those culpable and bring them to justice.
- That on the 22 nd of April, 2003 upon having identified the suspects, and duly informed the Homicide Section, your then

Deputy Commissioner of Police, X-Squad Section, F.C.I.D. Alagbon, Abdulrahman Olajide Akano prevented the arrest of the suspect by the police of the Homicide Section, alleging that the
suspects “are innocent” of the murder of our client inspite of the fact that the said Deputy Commissioner Police, Abdulrahman Olajide Akano was not in charge of investigation into the murder of Wale Amao neither was he the Head of homicide section which was in charge of the investigation of the murder, which action of your Deputy Commissioner of Police lead the Lagos State Directorate of Public Prosecution to unequivocally opined that “…it is not in doubt that Abdulrahman Olajide Akano prevented the arrest of the suspects…” bona fide wanted by the Homicide Section. Find attached herewith the legal opinion of the Director of Public Prosecution of Lagos State signed by Miss T.K. Shitta-bey with reference number LJP/ADV.321/03 dated 9 th March, 2004.
It was consequent upon the conduct of Abdulrahman Olajide Akano that a petition was raised by our Chief A.G Giwa-Amu and directed to the then Inspector-General of Police, Mr. Tafa Balogun alleging corruption, ineptitude, abuse of office e.t.c. against Abdulrahman Olajide Akano (then Deputy Commissioner of Police, X Squad Section FCID, Alagbon, Ikoyi, Lagos State).
In a dramatic twist, the prime suspect, Ganiyu Omoola produced two persons to wit: (i) Mr. John Folorunsho and (ii) Mr. Olatunji Oke who made confessional statements confirming that they murdered the said Wale Amao. See Police Statement made by the said Ganiyu Omoola dated 23 rd June, 2004 to Nigerian Police, Intelligence Section, Kam Salem House, Moloney Street, Obalende, Lagos State confirming the production of other murder suspects.
Mr. Inspector-General of Police sir, the question to be answered is why was it after the petition against your Abdulrahman Olajide Akano now Commissioner of Police and Mr. Ganiyu Omoola (the prime suspect) by our Chief A.G Giwa-Amu, that the two suspects to wit: (i) Mr. John Folorunsho and (ii) Mr. Olatunji Oke where brought by the prime suspects (Ganiyu Omoola)? How did Mr. Ganiyu Omoola know these suspects who made confessional statements.
In a further dramatic twist, our Chief A.G Giwa-Amu was arraigned on the 6 th October, 2003 in Chief Magistrate Court, Igbosere

for false information inspite of the fact that the said petition complained of as false (by Abdulrahman Olajide Akano) was the same petition which culminated into the arrest and present prosecution of (i) Mr. John Folorunsho and (ii) Mr. Olatunji Oke, while the police under the supervision of Abdulrahman Olajide Akano continued till date to shield Ganiyu Omoola and others. Please note that this charge against our Chief A.G Giwa-Amu was struck out on the 5 th June, 2004 only for the almighty Abdulrahman Olajide Akano with Mr. Etomi, (then A.C Legal), to re arrest, detain and again charge our Chief A.G Giwa-Amu to court on the 4 th of September, 2006 with a view to scuttle the murder case.
Sir, it is interesting to note that while our Chief A.G Giwa-Amu was being arrested, detained and charged to court, certain officers and men of your police force divulge through fax in your Deputy Inspector General, Force Criminal Investigation Department office, details of investigation and confidential document from the presidency to the murder suspect (Ganiyu Omoola) on the issue. Find attached copies of the said document confirming the breach of the Official Secret Act by your men.
Please be informed that the Giwa-Amu Family name was made both in the legal practice and in the police circle long before Mr. Sam Amuka engaged in board room squabble in Punch Newspaper which lead to his being flushed out of Punch Newspapers, and long before Abdulrahman Olajide Akano managed to pass through school with the aid of community assistance on grounds of impecuniosities of the Akano Family.
We wish to confirm that while the larger Amu Family has successfully produced 32 (thirty-two) Lawyers both in Nigeria and Abroad, the Akano Family have been a fountain head in the production of persons like Alhaji Rasheed Alayande Akano who is a notorious fraudster per records at the X-Squad Section, FCID Alagbon Close, Ikoyi, Lagos State.
We remain stead fast in our quest for justice no matter whose ox was gored.
We remain determined in our quest for justice, though the steps may be steep and deep, we are confident that we shall bring justice to the doorsteps of those who need us to serve them.

Our advice for Mr. Sam Amuka is that the test of a real man is not only his ability to hold his own but also to rein in his wife and family members.
We urge you to cause a detailed investigation into all issues raised in this statement.
