Ukaegbu alleged that the Abia police chief has been violating the court order through recognizing one Augustine Ehiemere as chairman.
The Court of Appeal ,Owerri Judicial Division had on April 7,2022, declared Ukaegbu,as the authentic chairman of APGA in Abia State.
He told Pointblanknews.com that after the judgment he had petitioned the Inspector General of Police,Usman Alkali Baba, who directed the Abia CP to look into the matter.
Ukaegbu disclosed that the Abia CP further directed her legal department who went to the State High Court and Court of Appeal,Owerri and verified the judgment including the fact that there was no pending appeal over the matter.
However,the Abia APGA alleged that after he took over the secretariat,CP Agbede has continued recognizing Ehiemere as the State chairman of Appeal in violation of the court judgment.
According to him, “The state High court , Umuahia gave a judgment affirming I, Prince Nnanna Ukaegbu as state chairman of APGA. They appealed to the Court of Appeal and lost. Instead of further appealing to the Supreme Court , they returned to the Court of Appeal and filed an application asking the court to reverse the judgment but the court dismissed the application and awarded N2 million cost against them. Ehiemere said they won’t appeal to the Supreme Court because he knows that I can never be the chairman of APGA in Abia State,despite the judgment. After the judgment ,i petitioned the Inspector General of Police who directed the Abia CP to look into the matter. The CP sent her legal department to the state High court and Court of Appeal who confirmed the judgment and also that there was no pending appeal over the matter. After these efforts, CP Agbede has been undermining the court judgment recognizing Augustine Ehiemere as the chairman of Appeal. It is unfortunate that the CP is violating the judgment of the court that it is not her duty to determine who is the legitimate chairman.”
Piqued by the illegal actions of CP Agbede, Ukaegbu has filed an suit against the Abia State Commissioner of Police,Ehiemere and Superintendent of Police, Robert Aduke.
In suit No. HU/229/2022, filed by his counsel, Ukpai Ukairo, at the state High Court, Umuahia, between Prince Nnanna Ukaegbu (claimant) and Augustine Ehiemere, Commissioner of Police, Abia State and SP Robert Aduke (Defendants), the APGA chairman prayed for a perpetual injunction restraining the defendants and their agents from taking possession or entering the APGA state headquarters at No. 128 Aguiyi Ironsi Layout , Umuahia, without his permission.
Other prayers sought include; “A declaration that by virtue of Article 11(5) of the Constitution of APGA, the claimant is entitled to administer the affairs of the state chapter of APGA from the office of APGA at N0.128 Aguiyi Ironsi layout, Umuahia, being the Abia state headquarters of the party.
“A declaration that the 1st defendant is not entitled to enter the said headquarters unless upon the leave of the claimant as the 1st defendant does not hold any office in the state executive of APGA state chapter of Abia. A declaration that the attempt by the 1st defendant to break and enter the said office and take over or retake the said Abia state headquarters of APGA with the aid of the 2nd and 3rd defendants jointly and severally is illegal, void and unsustainable.
‘A perpetual injunction restraining the defendants, their agents, assigns and others howsoever from entering the said headquarters without the leave of the claimant , attempting to forcibly evict the claimant from No.128 Aguiyi Ironsi Layout , Umuahia or enter the office or take possession of same.”
