AGF, Customs Dragged To Court Over N56 Million Contract Alleged Violations

GWWIL Communication Limited (GCL) has approached a Federal High Court
Sitting in Abuja, accusing the Nigerian Customs Service (NCS), and the
Attorney General of the Federation, AGF, of contract violations.
The contract’s title “Renovation and furnishing of the Nigerian Customs
Service Area Controller’s Quarters including landscaping at Bauchi,
Bauchi State” was awarded on December 24, 2014 for the sum of
N56,950,000 million.
The Claimant’s counsels, Mr Efekemdiaye Daniel Esq., Colins Marshall
Esq., and Abioye Damilola Esq. are urging the court to examine the
infractions.
According to the case fact in the file available to Pointblanknews.com,
the Claimant alleges that the NCS board failed in its contractual
obligations to pay the balance of 85 percent of the contract two years
after the project’s completion and hand over, which constitutes a breach
of agreement.
GCL in the court papers said they have received only 15 per cent of the
contract sum less mobilization fee upon presentation of insurance bond.
The alleged infractions include the unilateral downward review of
contract term of an already executed project adjudged satisfactory by
the respondents, two years after completion.
The GWWIL Communication Limited is asking to court to declare the
purported review by the board, dated November 21, 2017 illegal, null and
void.
Other reliefs sought include “the payment of N26,849,463.50 million to
the claimant in line with the agreement dated February 27, 2015 that is
in tandem with the Bill of Quantities.
“Plus, an accrued interest the said amount had generated from the date
the NCS Board issued its first certificate of satisfactory completion of
job/ handing over at the rate of the 20% up till the date of final
award.”
The claimant also seeks an order directing the NCS Board to pay the sum
of N47,669,892 million as special damages as well as an order mandating
the board to pay the sum of N2,847,500 million being retention fee
withheld by the NCS.
